Index ECM/ Subject/ 66.02 - Infrastructure Charges Instruments & Policy
(Council/State)
Attachments 1. Noosa Shire Council Charges Resolution (No.7) 2022
EXECUTIVE SUMMARY
This report recommends an administrative amendment be made to Council’s “Charges Resolution”
to align with the recently amended “Planning Regulation 2017, Schedule 16 Prescribed amounts”
(maximum permissible charge rates) that apply for the 2022-2023 financial year.
RECOMMENDATION
That Council note the report by the Infrastructure Assessment Coordinator to the Planning &
Environment Committee Meeting dated 9 August 2022 and adopt the “Noosa Shire Council
Charges Resolution (No.7) 2022” provided as Attachment 1 to the report, to replace the “Noosa
Shire Council Charges Resolution (No.6) 2021” and take effect on 19 August 2022.
REPORT
Council issues infrastructure charges on development under its “Charges Resolution” to help fund
provision of “trunk” infrastructure identified in its Local Government Infrastructure Plan (LGIP).
On 1 July 2022 through the “Planning Legislation (Fee Unit Conversion and Other Amounts)
Amendment Regulation 2022”, the State Government amended the “Planning Regulation 2017,
Schedule 16 Prescribed amount” that applies from 1 July 2022 for the 2022-2023 financial year in
lieu of the indexation otherwise applicable under Clause 112 (2) (b) of the “Planning Act 2016”.
The Queensland Legislation webpage has been updated with the amended “Planning Regulation
2017, Current as at 1 July 2022”. The updated prescribed (maximum) amounts equate to an
average 1.31% increase from the previous financial year.
To maintain direct consistency with the most current legislative/regulatory amendment, it is
recommended that Council’s current “Charges Resolution (No.6) 2021” be amended and replaced
with an updated “Charges Resolution (No.7) 2022” provided as Attachment 1 to this report to take
effect on 19 August 2022.
1. Summary of Amendments
The amendments are administrative only and relate to the following items:
1. Section 1.1 Short title
Update the charges resolution citation to: (No.7) 2022
2. Section 1.3 Effect
