Revival of development application (pursuant to Section 31.2 of the DA Rules)
Your Ref: MCU19/0073
We write in accordance with Section 31.2 of the DA Rules, to revive the development application made over
the above site.

On 18 July 2019, the applicant gave a copy of the application and confirmation notice to the referral agency
as required under Section 5.1 and 5.2 of the DA Rules. However, the applicant failed to give notice to the
assessment manager of the day the application was referred in accordance with Section 5.3 of the DA
Rules. As such, the application lapsed on 26 July 2019.

In accordance with Section 32.2 of the DA Rules, the applicant may revive the application within 20 days of
the application lapsing by undertaking the actions under Section 31.1. As such, we refer to our Notice of
Referral letter dated 29 July 2019 and confirm that we have now given notice to the assessment manager of
the day the application was referred.

To be clear, we confirm that the applicant intends to revive the development application. Required actions
have been completed as follows:

     •     The applicant has undertaken the actions in accordance with Section 31.1(a) of the DA Rules by
           providing notice to the assessment manager of when the application was referred on 29 July 2019.
     •     This letter involves the giving of the notice to the assessment manager noting that the above action
           has been undertaken in order to revive the development application within 20 days of the application
           lapsing.

As such, we consider the application to now be revived.
