TYPE 2 MEDICAL INVOLVING BUILDING WORK ASSOCIATED WITH RELOCATION OF
A BUILDING IN A HERITAGE CHARACTER AREA & RECONFIGURING A LOT (4 LOTS
INTO 2) AT 45 & 47A MAPLE ST & 9 MYALL ST COOROY
The following material was presented to the meeting in relation to this item:
Cr Stewart – refer to Attachment 4
Council Resolution
Moved: Cr Stockwell
Seconded: Cr Jurisevic
That Council note the report by the Coordinator Planning to the Planning & Environment
Committee Meeting dated 6 October 2020 and the further report to the Ordinary Meeting
dated 15 October 2020 regarding Application No, MCU20/0027 for a Development Permit for
Material Change of Use - Commercial Business - Type 2 (Medical) involving Building Work
associated with the relocation of a building within a Heritage Character Area and
Development Permit for Reconfiguring a Lot (4 lots into 2) situated at 45 and 47a Maple
Street and 9 Myall Street Cooroy and:
A. Refuse the application for the following reasons:
1. The proposed development is not consistent with the Desired Environmental
Outcomes 3.1.3(d)(i) and (ii) of the Noosa Plan 2006 as it does not protect the
heritage character building and provide for adaptive re-use of the existing
building.
2. The proposed development is not consistent with the Overall Outcomes 6.7.2(n)
and (r) of the Cooroy and Lake Macdonald Locality Code of the Noosa Plan 2006
as the proposed development does not maintain or complement the traditional
country streetscape and building forms of Cooroy.
3. The proposed development is not consistent with Specific Outcome O16 of the
Cooroy and Lake Macdonald Locality Code of the Noosa Plan 2006 as it does
not provide a traditional roof form which contributes positively to the local skyline
or complement the character of the locality.
4. The proposed development is not consistent with Overall Outcomes 13.16.2(f)(i),
(ii), (iv), (v) and (viii), Specific Outcomes O5, O6 and O7 of the Heritage Overlay
and Specific Outcome O63 of the Community Services Zone of the Noosa Plan
2006 as it:
i. does not retain the existing heritage character building;
ii. will adversely impact on the streetscape character;
iii. proposes a built form which is not reflective of the historic architectural
features in Cooroy; and
iv. does not maintain a domestic character and form consistent with the
Queensland vernacular specifically sought in Maple Street.
5. The proposed development is not consistent with Overall Outcomes 14.110.2 c)
and d) and Specific Outcomes O7 and O8 of the Driveways and Carparking Code
of the Noosa Plan 2006 as:
i. the proposed car parking arrangements will not meet the reasonable
requirements of the proposed use with the number of tandem spaces
excessive; and
ii. suitable manoeuvring areas for waste collection and service vehicles has
not been demonstrated.

ORDINARY MEETING MINUTES 15 OCTOBER 2020
6. The proposed development is contrary to the Noosa Plan 2020 provisions which
similarly seek to protect the heritage qualities of the site and the streetscape
character.

2 2020-21 COMMUNITY GRANT PROGRAM FUNDING - COMMUNITY PROJECT GRANT
– EQUIPMENT
In accordance with Chapter 5B of the Local Government Act 2009, Cr Wilkie provided the following
declaration to the meeting of a prescribed conflict of interest in this matter:
I, Cr Wilkie, inform the meeting that I have a prescribed conflict of interest in this matter in relation to
the application by Noosa Arts Theatre Inc as I am the President of that Association. As a result of my
conflict of interest, I will now leave the meeting room while the matter is considered and voted on.
In accordance with Chapter 5B of the Local Government Act 2009, Cr Stewart provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Stewart, inform the meeting that I have a declarable conflict of interest in this matter in relation to
the application by the Sunshine Coast Sports Aviators as one of the Club members, David Cookman,
donated $500 on 17 March 2020 to my 2020 election campaign and also put up corflutes for me during
this campaign. Mr Cookman, is not the applicant for the grant nor is the grant being issued to him. As
such, there does not appear to be any personal benefit accruing to Mr Cookman as a result of the
grant to the community organisation. He is simply a member of a community organisation that is
receiving a grant from Council. Mr Cookman is not a current committee member, although he has
been a committee member in the past. I understand that he is a life member of the community group.
Although I have a declarable conflict of interest, I do not believe a reasonable person could have a
perception of bias because I believe Mr Cookman does not stand to receive a personal benefit or loss
in relation to this application. Therefore, I will choose to remain in the meeting room. However, I will
respect the decision of the meeting on whether I can remain and participate in the decision.
Council Resolution
Moved: Cr Wegener
Seconded: Cr Jurisevic
That Cr Finzel be appointed as Acting Chairperson of the meeting for this item for the purpose of
considering the conflict of interest declarations.
Carried unanimously.
(Crs Stewart, Lorentson and Stockwell did not vote on the above motion)
In accordance with Chapter 5B of the Local Government Act 2009, Cr Lorentson provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Lorentson, inform the meeting that I have a declarable conflict of interest in this matter in relation
to the application by the Sunshine Coast Sports Aviators as one of the Club members, David
Cookman, approached me after a Meet the Candidates night and asked for some election campaign
posters to advertise on his properties. I did not know him or have any relationship with Mr Cookman
prior to meeting him that night. Mr Cookman is not the applicant for the grant nor is the grant being
issued to him. As such, there does not appear to be any personal benefit accruing to Mr Cookman as
a result of the grant to the community organisation. He is simply a member of a community
organisation that is receiving a grant from Council. Mr Cookman is not a current committee member,
although he has been a committee member in the past. I understand that he is a life member of the
community group. Although I have a declarable conflict of interest, I do not believe a reasonable
person could have a perception of bias because I do not consider that I have a close personal
relationship with Mr Cookman and I believe Mr Cookman does not stand to receive a personal benefit

or loss in relation to this application. Therefore, I will choose to remain in the meeting room. However,
I will respect the decision of the meeting on whether I can remain and participate in the decision.
In accordance with Chapter 5B of the Local Government Act 2009, Cr Stockwell provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Stockwell, inform the meeting that I have a declarable conflict of interest in this matter in relation
to the application by the Cooroora United Football Club as I have donated a total of $600 between
December 2016 and December 2019 to that club. This was for both a junior bursary and general
goodwill. Although I have a declarable conflict of interest, I do not believe a reasonable person could
have a perception of bias because of the community nature of this donation. Therefore, I will choose
to remain in the meeting room. However, I will respect the decision of the meeting on whether I can
remain and participate in the decision.
Council Resolution
Moved: Cr Jurisevic
Seconded: Cr Wegener
That Council note the declarable conflict of interest by Cr Stewart and determine that it is in the public
interest that Cr Stewart participates and votes on this matter because Council believes that Mr
Cookman will not receive a personal benefit or loss in relation to this application and therefore a
reasonable person would trust that the final decision is made in the public interest.
Carried unanimously.
(Crs Stewart, Lorentson and Stockwell did not vote on the above motion)
Council Resolution
Moved: Cr Jurisevic
Seconded: Cr Wegener
That Council note the declarable conflict of interest by Cr Lorentson and determine that it is in the
public interest that Cr Lorentson participates and votes on this matter because Council believes this
not a close personal relationship and that Mr Cookman will not receive a personal benefit or loss in
relation to this matter and therefore a reasonable person would trust that the final decision is made in
the public interest.
Carried unanimously.
(Crs Lorentson, Stewart and Stockwell did not vote on the above motion)
Council Resolution

ORDINARY MEETING MINUTES 15 OCTOBER 2020
4 PARK ROAD TEMPORARY PATHWAY UPGRADE
In accordance with Chapter 5B of the Local Government Act 2009, Cr Wegener provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Wegener inform the meeting that I have a declarable conflict of interest in this matter due to my
association with Andrew St Baker who owns a property in Park Road, adjacent to the where the
pathway is located. Andrew St Baker contacted me in May about the pathway in question which runs
on the northern edge of his property. I went to meet with him and looked at the path and he told me
the history of his dealings with Council. I contacted the Project Officer and passed on Mr. St Baker’s
concerns. Later, I informally met the Project Officer on the boardwalk and, I believe, he told me that
it will eventually come before Council. I have a perceived association with Mr. St Baker as I am a
surfboard manufacturer and he is an owner of Thomas Surfboards and the Thomas Factory. I believe
Mr. St Baker has had a fantastic influence on manufacturing in Noosa. In Council I have often
congratulated the Thomas Factory and I have discussed the emerging Enterprise Business Zones
which Mr. St Baker supports. During the Campaign Mr. St Baker allowed me to put an election core
flute at the Thomas Surfboard Factory. I occasionally meet Mr. St Baker in the surf and have had two
discussions of the Noosa Biosphere, the history of Noosa and the Bring Back the Fish campaign at
his house, which is, obviously, right above the surf break. Although I have a declarable conflict of
interest, I do not believe a reasonable person could have a perception of bias because I believe I do
not have a close personal relationship with Mr St Baker. Therefore, I will choose to remain in the
meeting room. However, I will respect the decision of the meeting on whether I can remain in and
participate in the decision.
In accordance with Chapter 5B of the Local Government Act 2009, Cr Lorentson provided the following
declaration to the meeting of a declarable conflict of interest in this matter:
I, Cr Lorentson, inform the meeting that I have a declarable conflict of interest in this matter due to my
relationship with Andrew and Cathryn St Baker who reside in Park Road adjacent to where the
pathway is located. My family have holidayed once with Andrew and Cathryn St Baker, my husband
is close personal friends with Andrew St Baker and one of my election signs was located at Thomas
Surfboards and Andrew St Baker is a joint owner of that business. As a result of my conflict of interest
I will now leave the meeting room while the matter is considered and voted on.
Council Resolution
Moved: Cr Stockwell
Seconded: Cr Jurisevic
That Council note the declarable conflict of interest by Cr Wegener and determine that it is in the public
interest that Cr Wegener participates and votes on this matter because Council believes that Cr
Wegener does not have a close personal relationship with Mr St Baker and therefore a reasonable
person would trust that the final decision is made in the public interest.
Carried unanimously.
(Cr Wegener did not vote on the above motion)
Council Resolution
Moved: Cr Jurisevic
Seconded: Cr Wilkie
That Council note the report by the Project Manager - Transport Innovation to the Services
& Organisation Committee Meeting dated 6 October 2020 and defer consideration of the
matter until the November round of meetings to seek further information from the Design
Team.
Carried unanimously.

11 PUBLIC QUESTION TIME
1 BRIAN O’CONNOR
Question 1:
Can Noosa Council provide an update on new arrangements regarding the suite of
library services it proposes to introduce following phasing out of the mobile library
service - specifically the use of book dispensing kiosks. Can the reply include
information about the towns where kiosks will be located, where they will be placed in
those towns, the number of books they will contain, how they will operate, the timing of
their installation, signage and whether thought has been given to placing two kiosks
adjacent to each other in larger towns (i.e. one for adult books and one for children's
books)? Making available a picture of the model of dispensing kiosk Council wants to
use would be helpful.
Response by Kerri Contini, Director Community Services:
Council officers continue to develop the options for a community outreach model of
library services for those areas that don’t have a branch library in close proximity. The
draft model includes a light rigid outreach vehicle operating on a weekly schedule, two
library kiosks, bulk loans to partner organisations and a schedule of learning programs
and workshops delivered throughout the shire. Consultation with the community about
the draft model will commence in December 2020 and will include information direct to
mobile library users, a roadshow displaying the different elements of the draft model,
posters on town/community noticeboards and meetings with key stakeholders. We
thank you for your interest in the kiosks and will ensure that there is plenty of detail and
images included when we do the community consultation.

ORDINARY MEETING MINUTES 15 OCTOBER 2020
Question 2:
Has Noosa Council given any thought to approving the design of 'street library' cabinets
and making these designs available to the public and also to men’s sheds across the
shire so that individuals can build or order street libraries in smaller towns in order to
encourage literacy and reading, as well as socialising facilitated by such facilities.
Response by Kerri Contini, Director Community Services:
The “street or little library” movement is growing around the world and is
enthusiastically supported by Council’s Library staff. These small community
collections encourage people to read, share books and connect with neighbours. There
are lots of designs available online for people to make themselves or they can be
bought fully built. To support the start-up of the “street library” concept, Noosa Library
Service established a number of little libraries several years ago. The little library
houses were made by Noosa Men’s Shed, stocked with ex library books and then
hosted by a range of community locations. The Library Service isn’t creating any more
street libraries as the concept has now taken off in Noosa and there are now community
street libraries around the shire. They do not require Council approval if placed on
private property. More information on street library designs can be found at
www.streetlibrary.org.au

The next Ordinary Meeting will be held on 19 November 2020 at the Council Chambers,

The attached petition requests a change to the guidelines in the current Noosa
Plan (Noosa Waters Estate Waterways) and a delay on any action against
residents until a solution is found
Yours truly

ORDINARY MEETING MINUTES 15 OCTOBER 2020
Objective / Purpose
To amend the current Noosa Plan (Noosa Waters Estate Waterways) to allow the
storage of registered watercraft, on or off pontoons and other devices, adjacent
to or perpendicular to the revetment wall, without directly being attached to a
jetty.
Background
Over many years, rules in regard to Noosa Waters (boat storage), essentially a
closed canal to the public, have been made and changed. From the size of jetties,
the attitude to boat lifts such as SeaPen, Airberth, attached or unattached
pontoons, the use of attachments particularly jet skis, mooring boats adjacent to
the revetment wall and attaching boats to the end of jetties.
The current practices of watercraft storage have been in place for at least 20
years and presented no problems to any residents or indeed Council.
Complaint/s
The action being undertaken by Council in raising Compliance Notices is the
result of complaint/s against presumably each of the residents who have
received these Notices.
It has been established the Noosa Waters Residents Association (NWRA)
supports Council in this action however they do not represent all waterfront
owners and have not publicised their support of Council with owners through
their normal communication methods.
The NWRA has advised their concern is the integrity of the revetment wall which
is absolutely reasonable. It ignores the possibility of a change to the Noosa Plan
to enable residents and tourists to store watercraft without any impact on the
revetment wall whilst maintaining safety in the canal.

Objective / Purpose
To amend the current Noosa Plan (Noosa Waters Estate Waterways) to allow the
storage of registered watercraft, on or off pontoons and other devices, adjacent
to or perpendicular te the revetment wall, without directly being attached to a
jetty.
Affected Users of the Noosa Waters Canal
Private waterfront owners and Resorts within the canal system.
Private Owners - have pontoon boats, single hull boats, jet-ski's and tinnies,
stored on or off a pontoon (and other devices) and may have more than one
watercraft, not attached to a jetty.
Resorts - that includes primarily The Entrance and Portside rely on substantial
income from tourists who bring their own watercraft to Noosa, This group also
includes premises rented for short or long term stays.
The Entrance has only four jetties for 51 residential units and these jetties are
built well above the level of the revetment wall, presenting safety concerns when.
boarding or alighting from boats.
Even if the jetties were all used, the peak holiday period can attract more
watercraft than available safe use of jetty space.
Current Practice
Current practices of watercraft storage (not attached to Jetties) has been in place
for at least 20 years and has presented no problems to residents or Council. A
recent informal inspection has shown that without exception watercraft owners
store their craft in a safe manner and do not impede passage in the canal and
have no impact on the canal bed or revetment wall.
Approvals
In recent years Council undertook a large project of adding rock ballast to the
base of the revetment wall and during this process the Body Corporate of The
Entrance and Council entered an agreement to enable watercraft to be stored
adjacent to the revetment wall. Rock ballast was installed at a height to enable
storage without damaging watercraft. This approval was given by the Councils
project manager in an email on 18 Sept 2014.

Objective / Purpose
To amend the current Noosa Plan (Noosa Waters Estate Waterways) to allow the
storage of registered watercraft, on or off pontoons and other devices, adjacent
to or perpendicular to the revetment wall, without directly being attached to a
jetty.
Whilst this express approval was directed to The Entrance, rock ballast height at
adjoining and presumably other properties, allowed the long term practice of
boat storage adjacent to the revetment wall to continue with tacit approval given
that no action has occurred for years after completion of the project.
Solutions
A. Private Residences.
1. Watercraft contained within the prolongation of boundaries of the lot and
setback minimum of 1 metre
2. Pontoons to be secured perpendicular by posts embedded in the canal
and not attached to the revetment wall. Posts to be at least 200mm from
wall
Note. Posts have no greater impact on the canal bed than the posts
supporting jetties
3. Watercraft not on pontoons to be secured to bollards or other engineered
device embedded behind revetment wall
4, Watercraft can be stored in tandem to a pontoon attached to a jetty
Resorts
B. Resorts and Rented Properties
1. Watercraft may be attached to jetties provided it can be done safely
2. Watercraft may be stored alongside revetment wall attached to existing
bollards or to and engineered device embedded behind revetment wall
3. Watercraft may be stored on pontoons or other devices secured to posts
embedded in the canal and not attached to revetment wall. Post to be at
least 200mm from wall

PETITION TO THE NOOS — URGENT DRAIN REPAIR
We request this petition be presented to the whole of Council
We, the residents of Stormbird Drive, Noosa Heads are requesting the urgent repair of a drain
under Eenie Creek Road, Noosa Heads
This drain requires urgent repair as a portion of Eenie Creek has sunk
The sunken road causes a very loud “bang” noise from trucks and trailers and is impacting our
quality of life. Our first customer request was lodged over 3 years ago. We have been waiting
over 3 years for this drain to be repaired so the road is reinstated with no slump.
Noosa Council, we ask for your urgent attention to this matter
