PURPOSE OF MEETING
The purpose of the Special Meeting was to consider MCU20/0012 & MCU20/0013 - Development
Application for Transport Type 2 Car Park at 4 - 8 and 16 Lower Mill Road, Cooroy and Open
Space Type 1 Sport and Recreation at 1, 3 and 9 Maple Street, Cooroy.

27 January 2021 regarding Application No. MCU20/0012 for a Development Permit for

Cooroy and MCU20/0013 for a Development Permit for Material Change of Use – Open
Space Type 1 Sport and Recreation (Playground) at 1, 3 and 9 Maple Street, Cooroy
and:

PLANNING
When Conditions must be Complied With
1. Unless otherwise stated, all conditions of this Decision Notice must be
complied with prior to the use commencing, and then compliance
maintained at all times while the use continues.
Approved Plans
2. Development undertaken in accordance with this approval must generally
comply with the approved plans of development. The approved plans are
listed in the following table unless otherwise amended by these conditions.

Carparking
3. Carparking must be provided and sealed in accordance with the approved
plans. All carparking, must be provided prior to the commencement of the
use of the playground approved under development application
MCU20/0013.
4. The concrete driveway on drawing DA04 Rev. A Design Features Carpark
Area 2 is not to be constructed as part of these works.
5. All car parking shall be kept maintained and line-marked in a condition fit
for use.
6. Appropriate signs shall be provided indicating the site as a Council Car
park.
Pathways
7. Concrete pedestrian pathways, detailed on the plans, must be provided in
accordance with Council’s standard drawing RS-065 and any associated
addendum. The works must include:
a. Any reinstatement of verge area must smoothly match the new
pathway,
b. The provision of topsoil, turf and any necessary stormwater drainage
measures to prevent ponding and excessive runoff over the
pathways.

Stormwater Drainage Management
8. In conjunction with the development application for operational works,
provide an updated Stormwater Quality Management Plan and engineering
drawings which are based on a revised model which addresses the
following:
a. Only include those sub-catchments which form part of the proposed
works or which contribute flow to the devices proposed to treat the
proposed works;
b. Only include treatment devices which actually exits or which are
proposed to be built or refurbished as part of the proposed works;
c. Existing GPTs are not to be modelled as receiving and treating
roofwater unless this physically occurs on site; and
d. Additional treatment devices are to be provided as necessary within
the car parking area in order to meet the pollutant load reduction
design objectives specified by the Water Sensitive Design Code.
9. Proposed and refurbished bioretention devices are to be designed
generally in accordance with the Bioretention Technical Design Guidelines
(Water by Design, 2012) and IPWEAQ standard drawings
10. Permanent educational signage must be erected to educate the public
about the function of the bioretention device(s). The dimensions, standard,
presentation and location of the educational signage must be in
accordance with an Operational Works approval.
Public Services
11. All necessary approvals from external service providers and external
parties on which the development works are proposed or impacted on must
have been obtained and a copy of approval/s supplied to Council prior to
the commencement of the works.
Easements
12. Where required, any public or third party infrastructure located on the
subject site must be placed within an easement registered against the title
of the property and in accordance with the requirement of the public service
provider.
13. All easements must be designed in accordance with the planning scheme
and granted at no cost to the Grantee. Where the Grantee is Council or a
service authority, the easement documentation must be in accordance with
the Grantee’s standard easement terms. Draft easement documentation
must be submitted to Council for endorsement.
Landscaping Works
14. The development site must be landscaped. The works must be undertaken
in accordance with the Noosa Plan 2020 Planning Scheme Policy 2 –
Landscaping for that specific area and must include in particular:
a. Carpark shade trees in a minimum pot size of 45L for every four
carparks
b. Carpark shade trees must have sufficient structured soils to allow for
proper root growth

15. All landscape works must be established and maintained in accordance
with the approved design for the life of the development, and in a manner
that ensures healthy, sustained and vigorous plant growth. All plant
material must be allowed to grow to full form and be refurbished when its
life expectancy is reached.

Currency Period
3. This development approval lapses if the use has not happened by 29
January 2027, unless an application to extend the currency period is
approved by Council.
Stormwater Drainage Management
4. Stormwater must be treated in accordance with the recommendations of
the Stormwater Quality Management Plan Revision 1 prepared by
Callaghan and Toth dated July 2020.
Flood Risk
5. All infrastructure with potential to be impacted by flood waters, including
electrical and plumbing fixtures and pump-room plant and equipment is to
be located above, or be able to safely withstand the 1%AEP flood level
corresponding to year 2100 planning period.
6. An automatic flood warning system incorporating both an audible and
visual alarm is to be provided to alert visitors to evacuate the site as soon
as flood waters begin to impact the playground and with sufficient warning
time to ensure full site evacuation prior to evacuation routes becoming
inundated.
7. The playground design is to be amended to eliminate the risk of isolation
of all site areas by rising flood waters. This may involve either modification
to site levels or provision of linking elevated walkways and evacuation
routes which remain flood-free until each area of the site which the
evacuation routes service is itself inundated.
8. The playground design and associated flood model is to be amended to
eliminate any increases in the flood levels affecting over-floor flooding at
adjacent buildings for all flood events.
9. Provide an updated flood emergency preparedness and management plan
which incorporates the above changes and which includes RPEQ
certification that the proposed final playground design achieves an
acceptable and tolerable level of flood risk. This plan must be completed
and certified prior to commencing works on site.
10. Any fencing must be designed in a manner so that it does not impede flood
waters or lead to a blockage.

Car parking
11. 56 additional car spaces must be provided prior to the commencement of
the use of the playground. The car parking is to be provided in the following
manner:
a. Lower Mill Road (22 additional formally sealed and line-marked
spaces)
b. Maple Street road reserve (12 formally sealed and line-marked
spaces)
c. Southern side of Mary River Road west of the tennis courts (22
spaces) be constructed as an overflow parking area.
12. The overflow parking area must be monitored for a full week in school
holidays and a full week outside of school holidays after the playground
has been fully operational for three months (and again at six months). The
results of the surveys must be provided to Council’s Manager Development
Assessment.
13. The overflow parking area must be formally sealed and line-marked if
regular use is identified at either period of monitoring referred to in
Condition 11.
14. The parking on the southern side of Marara Street must be amended as
follows:
a. The three (3) parking spaces closest to the existing disabled parking
spaces must be signed as being for 15 minute parking.
b. Three (3) months after that change has been implemented, usage
should be reviewed to determine whether the number of 15 minute
spaces (for short duration library trips) should be increased or
decreased to meet demands.
c. The remaining four (4) parking spaces in that existing 2 hour parking
zone be clearly signed as being for library use only.
Soil Contamination
15. Prior to the commencement of the use of the playground:
a. A Remediation Action Plan must be prepared and submitted to
Council which includes the following actions:
i. Provision of a Waste Acceptance Letter from an approved
waste management facility
ii. Excavation of approximately 30 m3 of impacted
TCDD/PCDD/F in the vicinity of BH27 for temporary stockpiling
and disposal.
iii. Following excavation/remedial excavation works, at least of 8
validation samples (including Quality Assurance/Quality
Control) must be collected from base of the excavation and
stockpile of excavated material.
iv. Validation samples must be analysed for presence of
TCDD/PCDD/F by an approved laboratory analyst.
v. A Quality Assurance/Quality Control program must be
implemented as part of the laboratory analysis.

vi. Quality Control field samples must include collection of one
field duplicates, at a ratio of 1 in every 20 primary samples
analysed.
b. The contamination report must be updated and submitted to Council
to include the remediation and validation testing results.
c. The site must be removed from the Environmental Management
Register.
16. No contaminated material, including but not limited to fill and timber, is to
be used in the construction of the playground.
Pedestrian and Bicycle Facilities
17. Pedestrian and bicycle facilities must be provided for the development. The
works must be undertaken in accordance with an Operational Works
approval and must include in particular:
a. internal pedestrian footpaths in accordance with the approved plans
b. a total of 20 bicycle parking spaces
Damage to Services and Assets
18. Any damage caused to existing services and assets as a result of the
development works must be repaired at no cost to the asset owner at the
following times:
a. where the damage would cause a hazard to pedestrian or vehicle
safety, immediately; or
b. where otherwise, upon completion of the works associated with the
development.
19. Any repair work which proposes to alter the alignment or level of existing
services and assets must first be referred to the relevant service authority
for approval.
Landscaping Works
20. The development site must be landscaped. The works must be undertaken
in accordance with the Noosa Plan 2020 Planning Scheme Policy 2 –
Landscaping for that specific area and must include in particular:
a. the works shown on the Approved Plans
b. Control of all weeds species listed in the following standards and
legislation:
i. declared plants under the Land Protection (Biodiversity Act
2014 and sub-ordinate Regulation 2016).
ii. Noosa Local Government Area Pest Management Plan 2015-
2019.
iii. Undesirable Plant Species listed in Table SC6.3.5.1 of the
Noosa Plan 2020 Planning Scheme Policy 2 – Landscaping
21. All landscape works must be established and maintained in accordance
with the approved design for the life of the development, and in a manner
that ensures healthy, sustained and vigorous plant growth. All plant
material must be allowed to grow to full form and be refurbished when its
life expectancy is reached.

Lighting
22. The development must be undertaken and operated in a manner that
causes no detrimental effect upon the amenity of the neighbourhood by
reason of lighting nuisance.
B. Note the report is provided in accordance with Section 63(5) of the Planning Act
2016.
