PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 JULY 2022 4 FURTHER REPORT - MCU21/0083 - APPLICATION FOR A MATERIAL CHANGE OF USE – MULTIPLE DWELLINGS (10 X DWELLING UNITS) AT 25 AND 27 TOOLAR STREET, TEWANTIN Author Coordinator Planning, Patrick Murphy Environment and Sustainable Development Department Index ECM/ Application/ MCU21/0083 Attachments 1. Proposal Plans EXECUTIVE SUMMARY A report for this application was presented to Council at the Planning and Environment Committee on 12 April 2022. The report recommended that the application be refused based on the proposal not complying with site cover, plot ratio, setbacks and landscaping and the development not being consistent with the streetscape or the surrounding area. On 19 April the applicant stopped the Decision-Making Period until 22 April 2022 and subsequently extended the Decision-Making Period until 21 July 2022 to allow for an amended proposal to be considered by Council. The proposal has been amended by increasing the number of dwellings from 8 to 10, consisting of 8 x 2 bedroom dwellings and 2 x 3 bedroom dwelling, making 8 of the dwellings small dwellings to take advantage of the scheme’s bonus provisions. The amended proposal now complies with the planning scheme’s maximum site cover and plot ratio requirements. The amended proposal has increased the front setback to 5.0 metres, with some part of the buildings setback up to 7.0 metres. The proposed setback is supported and is consistent with an outcome that was agreed between the parties. Whilst the application remains short of the required landscaped area the variation is minor, noting that the soft landscaping exceeds the scheme requirement. The amended proposal results in reduced setbacks to the rear boundary which are generally supportable. The reduced setback to 2 upper-level decks, at 1.5 metres, requires treatment to address overlooking The amended proposal plans are short of 1 visitor car space it is recommended that a condition be included to require the provision of this space. The application is before Council as two of the applicants are Noosa Shire staff members. RECOMMENDATION That Council note the Further Report by the Coordinator Planning to the Planning and Environment Committee Meeting dated 12 July 2022 regarding Application No. MCU21/0083 for a Development Permit for a Material Change of Use – Multiple dwellings (10 dwelling units) situated at 25 and 27 Toolar Street Tewantin and A.
