PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 17 JUNE 2014
The showroom buildings situated east of the site are 1 storey and approximately 7.5 metres at
their highest point and have frontage to Eenie Creek Road and Hoffmann Drive, while the office
buildings directly south of the site are 2 storeys and approximately 8.5 metres at their highest
point.
A maximum height of 10m is accepted for the bulk of the Masters building as this is consistent
with the maximum height of buildings permitted for the adjoining industrial land west of the site. It
is also accepted that this height may be measured from the finished ground level only rather than
the natural and finished ground level, recognising that some earthworks are necessary to achieve
a suitable building platform. Stepping the maximum height of the garden centre to 9m assists in
ensuring the 9822m2 building does not visually dominate the entrance to the Shire Business
Centre. This will be assisted by the wide landscaped garden beds to Hofmann Drive. The
reduced roof pitch of 5 degrees over the garden centre is consistent with the minimum roof pitch
specified for buildings by The Noosa Plan. The mechanical plant is generally located to the
buildings centre and is not expected to be visually obtrusive.
Condition 11 – Performance Bond
11. Security in the form of a cash bond or trading bank guarantee to the sum of $50,000 must
be submitted to Council, to secure performance of all conditions of this approval, prior to
the issue of a Development Permit for Operational Works. The cash bond or trading bank
guarantee will be returned on performance of the conditions of approval less any costs
incurred by Council in respect of enforcing performance of this permit. Council reserves
the right to call upon the bond or guaranteed sum to effect compliance with conditions.
Applicant’s Representation
The applicant considers the provision of security for the amount of $50,000 to be an
unreasonable condition because non-compliance with a condition will constitute a development
offence and the Council has the statutory mechanism to compel compliance. A security is
therefore unnecessary. Through negotiations the applicant has agreed to accept a reduced bond
of $35,000.
Assessment of Representation
The condition is consistent with the Noosa Planning Scheme Policy 7 – Performance Bonds, with
the bond being an incentive to develop in accordance with the conditions of approval. A bond
has been consistently applied to all development approvals in the Noosa area. Given that
minimal external works area required and there are limited critical site attributes apart from the
open space buffers to the major road network which is under a covenant, a lesser bond of
$35,000 may be accepted.
Condition 13 – Built Form
13. The canopy proposed to the front entrance of the Masters building shall be extended to
the west as far as the internal pedestrian walkway, and remain exposed and open as a
roof on columns. This shall be incorporated as part of the amended plans and
resubmitted to Council prior to the issue of any Development Permit for Operational
Works.
Applicant’s Representation
The applicant has provided amended plans to address the requirements of the conditions and
requests the condition to be amended accordingly.
Assessment of Representation
Agreed.
