Good afternoon Callan,
I have reviewed the proposed plan and your conclusion that the proposed RAL does not result in interfering with core koala habitat within the koala priority area.
From my review it seems the proposed RAL does not result in interfering with koala habitat which would result in prohibited development, and that any interfering as a result of the RAL should be consistent with the definition of ‘exempted development’ in Schedule 24 of the Planning Regulation 2017. The proposed building envelope is outside of the koala habitat area and the new boundary line will be afforded the exempted development allowances as you have pointed out below.
Any future interfering with koala habitat (for elements such as fire breaks from buildings/infrastructure, constructing tracks/roads, etc) will need to also meet the exempted development definition.
I would like to confirm it is the developer/land owners responsibility to ensure any proposed interfering with the koala habitat on site must be carried out under the exempted development provisions, at both the RAL stage and future development of the site for the construction of a dwelling etc.
I would also like to note that the vegetation is identified as Category C on regulated vegetation management map. Whilst there is no need to refer the RAL for this category of vegetation, it is important to note that any future clearing needs to meet the accepted development codes for vegetation clearing as detailed on DNRME’s website – https://www.qld.gov.au/environment/land/management/vegetation/clearing-codes.
I hope this assists you in finalising the development application submission with the council.
Kind regards,
Candace Canniffe

Subject: 9A Jirrima Cres, Cooroibah - Koala Vegetation
Hi Candace
We’ve recently submitted an application to Noosa Shire Council for the subdivision of the above property at 9A Jirrima Crescent, Cooroibah. Council are not accepting the application until we receive confirmation from DSDMIP that it doesn’t constitute ‘prohibited development’ due to the presence of Core Koala Habitat Area in a Koala Priority Area.
Please find attached our submitted Plan of Development, with added layers demonstrating the extent of exempt clearing currently allowed on the site and the additional exempt clearing as a result of the new boundary placement. On the following grounds, we believe that the application does not constitute prohibited development:
In accordance with the Planning Regulations 2017, a 5m wide strip for vegetation clearing along the northern boundary of Lot 101 on SP168341 is considered ‘exempted development’ in accordance with Schedule 24 with particular reference to item (l) (shown below).
The remaining of the mapped ‘core koala habitat’ that does not fall within the 5m from the north boundary of Lot 101 on SP168341 does not equate to more the 500m2 (being 111m2, per the attached plan), and as such is considered ‘exempted development’ in accordance with Schedule 24 with particular reference to item (k) (shown below).
As such, we consider that the proposed development does not constitute prohibited development.
Could you please confirm the above interpretation of the Planning Regulation 2017 in relation to the koala habitat matters and that the proposed development is not ‘prohibited development’, so that Noosa Shire Council may accept the application. Thanks Candace.
Kind Regards,
Callan Lowrie B.Urb.Reg.Plan
