DEVELOPMENT ASSESSMENT REASONS FOR EXEMPTION
The Planning Act 2016 allows exemption certificates to be issued where ‘the effects of the
development would be minor or inconsequential, considering the circumstances under which the
development was categorised as assessable development’.
The works are to replace the existing roof and provide toilets at the ground floor level that achieve
the current accessibility standards within the Disability Discrimination Act 1992 and the National
Construction Code (NCC).
As the proposed works are considered minor/inconsequential in nature and do not introduce any
additional assessable requirements, it is recommended that exemption be granted for the specific
identified works.
The proposal is compliant with all other requirements of Noosa Plan 2020.

3. COMMENTARY
Council determined that the proposal was exempt for the following reasons:
1. The Noosa Plan 2020 requires code assessment for building work not associated with a
material change of use if within a Medium Impact Industry Zone and the effects of the
development would be minor or inconsequential, considering the circumstances under which
the development was categorised as assessable development.
2. The works are to replace the existing roof and provide toilets at the ground floor level that
achieve the current accessibility standards within the Disability Discrimination Act 1992 and
the National Construction Code (NCC).
3. Separate approval is required for the pylon sign included within plan no. AS.75 A011
4. CONCLUSION
A development approval is not required for the following assessable development:
• Building Work Assessable against the Planning Scheme (New Roof & Upgrade Toilets).
