Delegated Report - Code - Planning RAL21 0029
Author Development Planner, Lisa Pienaar Development Assessment APPLICATION DETAILS Application No. RAL21/0029 Applicant Rhiana Magee Proposal Reconfiguring a Lot - Rural Residential Properly Made Date 30 November 2021 Information Request Date 15 December 2021 Information Response Date 9 March 2022 Decision Due Date 17 May 2022 Report Completed Date 16 May 2022 Report Reviewed By Nadine Gorton PROPERTY DETAILS Property Address 15 Jirrima Cres Cooroibah Qld 4565 RP Description Lot 43 RP 136461 Land Area 41050 m² Existing Use of Land Vacant with the exception of an old out building STATUTORY DETAILS SEQRP Designation Rural Living Zone Rural Residential Precinct Not Applicable Local Plan Area Not Applicable Overlays Acid Sulfate Soils (Area 1: 5m AHD or below, Area 2: above 5m AHD to 20m AHD) Biodiversity, Waterways and Wetlands (Areas of biodiversity significance, Waterways, MSES Regulated Vegetation - intersecting a watercourse, Riparian buffer area) Bushfire Hazard (High potential bushfire intensity, Potential impact buffer) Flood Hazard (Waterways, Flooding and inundation extent) Assessment Type Code PROPOSAL The application seeks approval for a Reconfiguring a Lot – 1 into 2 Rural Residential lots. Proposed Lot 1 is 1.652ha (including access easement A: 1,520m2) and proposed Lot 2 is 2.454ha. Access is provided via a new driveway and crossover from Jirrima Crescent along the existing southern boundary. Access is via a common, 10.1m wide access easement (with a 4.5m 4 wide sealed pavement area), burdening Proposed Lot 1 and benefitting Proposed Lot 2. The locality and proposal plan are included below. Figure 1 – Locality Figure 2 – Reconfiguration Plan Figure 3 – site and house site area plan site details Background A prelodgement meeting (PLM21/0040) took place 21 July 2021. Matters for consideration such as vegetation covenants and building footprints were discussed and it is noted this application responded to the issues raised. Site Description The site is flat with a 91 metre frontage to Jirrima Crescent. The site is largely cleared with clusters of mature vegetation throughout the site. There are waterways external to the site to the front and rear of the site. Surrounding Land Uses The site is surrounded by rural residential development. To the west smaller rural residential developed lots are situated. Surrounding sites have similar environmental characteristics as this site. assessment Instruments for Statutory Assessment Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development: State Planning Policy; South East Queensland Regional Plan; Planning Regulation 2017; and Noosa Plan 2020. Noosa Plan 2020 The following codes from the Noosa Plan 2020 are applicable to this development: Rural Residential Zone Code; Reconfiguring of a Lot Code; Works Codes; Biodiversity, Waterways and Wetlands Overlay Code Bushfire Hazard Overlay Code The subject site is located in Cooroibah and is zoned rural residential. The proposed use is identified as a consistent use within the zone and is required to follow a code assessable application process. The application has been found to generally comply with all applicable statutory instruments. The pertinent issues arising out of the assessment are discussed below: Criteria Planning Scheme Proposal Complies Lot size 1.5ha min Lot 1: 1.5ha (excl access easement) Lot 2: 2.301 ha Flood Hazard The site is marginally affected by the Flood Hazard overlay at the front and rear of the property. Refer Figure 4 – Flood Hazard overlay. Proposed access to the property is outside of the flood hazard area and egress from the site onto the major road network is achieved when heading south. However, it is recognised that the broader Cooroibah area may potentially be cut off from Tewantin via McKinnon Drive (Wooroi Creek) for a period of 4.5 days during a 72 hour Probable Maximum Flood (PMF) flood event, but would not expected to be cut off during a defined flood event (1%AEP). There is no risk of people being isolated within the property in a flood event. No house sites are proposed in the Flood Hazard area. It is noted 23 Jirrima Crescent was approved by Court Order (RAL20/0019) where it was noted the house sites were situated above the flood levels. It is therefore considered the risk of increased persons with one additional lot is low. The proposal meets the Acceptable outcomes of the Flood Hazard overlay code. Figure 4 – Flood Hazard overlay Biodiversity, Waterways and Wetlands Overlay The majority of the front boundary (proposed Lot 1) including a small portion of the proposed easement (Easement A) is located in a mapped riparian buffer area with the access point being selected as the least affected area with five trees identified as requiring to be removed with a proposed offset of a 1:1 ratio. Refer Figure 5 – Location of access easement – riparian buffer area. A mapped waterway is located adjacent to the north-east corner of the lot. Figure 5 – Location of access easement – riparian buffer area A second mapped riparian buffer is located on the western boundary of the lot within the proposed Lot 2. No new boundaries traverse ecologically important areas and linages. Future house sites are identified as being located outside of these areas. Rehabilitation and Vegetation Covenant The Ecological Assessment Report provided by the applicant determined that the placement of infrastructure and buildings has minimised the potential impact on the environmental values of the site with only five Melaleuca quinquinervia proposed to be removed that are classed as Category X regrowth. The use of building envelopes, tree protection measures and the proposed rehabilitation plan will all reduce impacts and improve vegetation communities across the site. The Ecological Assessment Report ground-truthing identified that the riparian buffer zone in the north-eastern section of the site did not contain characteristics consistent with a riparian area or support natural water flow or retention and would not benefit from protection in perpetuity under a covenant. Council does not support this argument as the site has been highly modified over a long period with rehabilitation in both riparian buffer areas to provide additional environmental benefits to the mapped waterways. The application proposes that the two riparian buffer areas will be protected in the form of two vegetation protection covenants situated at the rear and front of the site (Covenant Area B and Covenant Area C). Refer Figure 6 – Covenant areas. An ecological Rehabilitation Plan identifies rehabilitation and weed removal activities within the two riparian buffer areas. Figure 6 – Covenant areas Covenant Area B is 5840m2 and Covenant Area C is 5101m2 in size. The rehabilitation and protection of these riparian buffer areas will provide and enhance fauna habitat areas and fauna movement corridors in particular Koala habitat areas. The Biodiversity, Waterways and Wetlands Overlay Code PO2 requires that new lots are only created if they maintain ecological linkages. The proposed development maintains and will enhance the linkages through rehabilitation and the vegetation will be protected by the proposed covenants as required by corresponding Acceptable outcome AO2 of the code. Council officers are supportive of the two vegetation protection covenants and rehabilitation required under an Operational Works Approval. This will be conditioned accordingly. Koala The development is mapped under a Koala Priority Area but is not interfering with koala habitat. Therefore, under Schedule 11 of the Planning Regulation 2017 there is no assessment applicable against the benchmarks. The application is proposing to rehabilitate large sections of the riparian buffer which will increase the fauna habitat and corridors. Bushfire Management The development area is mapped as high potential bushfire intensity on the north and west boundaries and potential impact buffer over the remainder of the site. The site is predominantly cleared/mowed grass with Melaleuca quinquenervia woodland with a canopy height of 20m on the north/north eastern and western sides of the site. The Bushfire Risk Assessment and Bushfire Risk Management Plan (8 March 2022 Revision 2 prepared by Ecological Natural Area Management) details that the development site is located in a bushfire prone area (Potential hazard area only) but does not increase the extent and severity of the bushfire hazard. The following requirements were included within the report: Houses constructed to BAL12.5; House sites in low hazard area to achieve a setback of 10 metres from any retained vegetation; Bushfire fuel free zone around the house; Houses will have access to water e.g. dam, swimming pool, tank with a volume of not less than 5,000 litres and standard fire brigade fittings fitted; Escape route available through a safe area with radiant heat less than 10kW/m2; No vegetative clearing is required to mitigate the bushfire risk. The Bushfire Management Plan provided with the application complies with the Bushfire Hazard overlay code. cONSULTATION Referral Agencies Not Applicable Internal Council Referrals The application was forwarded to the following internal Council officers for review and/or comment: Senior Environment Officer, Development Assessment (conditions recommended) Engineering Coordinator, Development Assessment (conditions recommended) conclusion & reasons for decision The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval. The report is provided in accordance with Section 63(5) of the Planning Act 2016.
