As a result of these meetings the applicant wishes to submit amended plans (refer attachment A) that are considered to address the matters raised at the meetings. th th At these meetings (16 May 2017 and 7 August 2017) a range of items were discussed and a response provided below: Site Cover The revised plans illustrate the replacement of the existing fixed umbrellas with a tension membrane shade sail that attaches to the roof and slopes to the boundary of the site. The new sail is low key and matches the existing roof line compared to that of the existing umbrellas. It is noted that the umbrellas have been on site for almost 20 years. Street awning The Noosa Drive frontage of the site faces west with the tenancy suffering significant heat and glare impacts in the afternoon. Consistent with other premises in Hastings Street including the adjoining Laguna Jacks, the applicant wishes to provide an awning over the front landscaped area and part of the footpath. In this regard a retractable awning is proposed and replaces the existing red umbrella at the front of the site. Streetscape Presentation In response to concerns raised by Council about the openness and streetscape presentation of the building, revised plans are submitted which now include the use of composite timber planks across the façade of the existing concrete slab as well as around the roofline to provide a coastal theme to the building. The white umbrellas are to be replaced with a single tensile shade sail secured to the existing building. In response to concerns raised by Council officers about updating the existing building, the project architect has proposed a timber portal around the existing shopfront. This timber portal defines the tenancy and presents a cohesive and stylish façade to the street.

The proposed works have been assessed against the Overall Outcomes of the Noosa Heads locality and
are considered to comply with the relevant outcomes including:
dd) Hastings Street’s character of low rise buildings, vibrant pedestrian friendly streetscape, mix of
indoor and outdoor activities, diverse dining opportunities, specialty Retail businesses and
pedestrian links to Main Beach is maintained;
qq) For the Visitor Mixed Use Zone—development—
i. comprises small business outlets with individual character
ii. comprises residential development that includes a mixture of building sizes and are designed
for Visitor accommodation, are setback from the street and beach frontages and have a
landscaped character consistent with the street landscaping themes;
ii. contributes to a high level of residential amenity, design quality, landscape quality and safety;
iii. respects the scale and character of the streetscape and surrounding development;
iv. enhances the traditional focus for Visitor accommodation in the coastal part of Noosa;
v. incorporates Entertainment and dining businesses, Retail businesses and Commercial
businesses that are of particular interest to visitors;
vi. contributes to the economy of Noosa through the tourism and hospitality sectors; and
integrates with nearby public recreation and landscaped carparking areas;
The existing approved tenancy has no landscaping, provides a hard interface to pedestrians and presents
an ad hoc façade to Noosa Drive through the use of different coloured sails. The revised plans illustrate a
small business that has an individual identity (all Grill’d restaurants have their own character) and
respects the scale and character of the Noosa Heads area through use of lightweight materials.
Landscaping
Council staff have raised concerns with the presentation of the proposal to the street with particular
reference to a landscaped setback to Noosa Drive. The Landscape Code of the Noosa Plan details that a
minimum landscaped area with an average width of 2.0 metre to Noosa Drive is to be provided. The
revised plans detail a landscape setback of that ranges from 1.8 metres to 1.0 meters with an average of
1.5 metres. Whilst the setback is not fully compliant with the stipulated dimensions the proposed setback
and landscaping is considered consistent with the Specific Outcomes as it enhances the streetscape by
providing landscaping in an area that currently has no plantings and suits the nature of the existing
development on site. Refer figure 1 below.

Seating numbers
At the meetings with Council staff it was noted by all parties that:
• The site had approval issued in August 1994 for a restaurant and outdoor seating for 50 patrons
under TPC 2696.
• A condition of the approval stipulated that outdoor seating was to be limited to 50 seats with a
total area of 80m2 approved for the premises.
• A contribution for 2 carparking spaces was paid by the applicant.

Page 3
• The planning report assessing the application did not detail any requirements as to why 50 seats
was detailed.
• The 50 seat limitation could have related to toilets on site. Current advice from a private certifier
indicates that the amenities comply with current standards and is not a reason to limit seating.
• The Noosa Plan 2006 no longer restricts or assesses carparking based on seating numbers.
It was concluded that the condition relating to seating numbers was no longer relevant and should be
removed.
Carparking
It was noted by all parties that carparking contributions had been paid for the site.
The proposed changes are considered to improve the building and enhance the streetscape in the area
and should be approved. Due to significant time penalties the applicant is currently experiencing, the
applicant requests that the application be reported to the next Planning & Environment meeting of the 12
September 2017.
If you have any queries in relation to the application please do not hesitate to contact me.
