Information Request MCU20 0145
Officer: Patrick Murphy Direct Telephone: 07 5329 6436 Our Reference: MCU20/0145 Your Reference: NA 7 January 2021 Noosa Council C/- Pivotal Perspective Pty Ltd 4/59 Mary St NOOSAVILLE QLD 4566 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. MCU20/0145 Street Address: Noosa District Sports Complex 31 Butler Street Tewantin Real Property Description: Lot 372 MCH 3843 Planning Scheme: Noosa Plan 2020 (25 September 2020) INFORMATION REQUIRED The information requested is set out below: Issue Although the planning report indicates there will be no additional noise impacts likely to cause a nuisance, the lighting over four (4) additional courts is likely to increase the noise impacts from the activity (netball) between the hours of 7pm – 10pm. The increase in intensity of the existing use (which is already at a high intensity operating 5 nights a week up to 10pm) is occurring at the four (4) courts located nearest to residents (within 100 metres), increasing the potential for noise nuisance from the activity. Namely: cheering calling out of players, umpires and spectators, whistles and noise from players running etc. It is noted that AO12 of the Recreation Activities Code includes a requirement that outdoor recreation facilities are not used between the hours of 9.30pm and 6.30am the following day. The amenity provisions within the code also include the provision of an operation management plan. Information Required To this end, further information is requested on how the noise from the increase in intensity of the activity will be mitigated and managed. This should include, but not limited to, a response to the amenity provisions within the Recreation Activities Code. Issue AO29.4 of the Recreation and Open Space Zone seeks that lighting is directed onto the site and away from neighbouring properties. The proposed plans detail that the lighting is directed towards the neighbouring properties. Whilst light spill associated with the lighting may comply with the relevant Australian Standard the direction of the lighting creates the opportunity for occupiers of the adjoining residential properties to have upward views directly into the lights. Information Required An amended layout with the lights facing away from the residential properties or alternatively suitable justification for the proposed direction of the lighting. due date for response to information request The due date for providing the requested information is 7 April 2021. Please advise Council of your response to this information request in accordance with section 13 of the Development Assessment Rules. If you do not provide a response before the due date, it will be taken as if you have decided not to respond to the information request and Council will continue with the assessment of your application. other details You can follow the progress of this application online at www.noosa.qld.gov.au.
