1. DETAILS
The proposal seeks an exemption for alterations and additions to an existing dwelling house
located on land described as Lot 608 RP 883862 and addressed as 37 Masthead Quay Noosaville.
The Planning Act 2016 allows exemption certificates to be issued where ‘the development was
categorised as assessable development because of an error’. The development is eligible for an
exemption certificate as:
The Low Density Housing Code includes an error in that an ‘or’ has been excluded between
Acceptable Outcome AO22.1 and AO22.2, and that a slope stability report will satisfy the
acceptable outcomes if the report demonstrates as low or very low risk.
In this instance, the subject land is mapped within the Landslide Hazard Overlay, however, the site
is already improved with a dwelling house and the proposal is for a lift addition within the existing
building footprint.
