PROPOSAL
The applicant seeks approval to change to an existing development approval for a private jetty to extend the jetty and obtain approval for a boat lifting device.

Instruments for Statutory Assessment
Under the Planning Act 2016 the application must be assessed against each of the following statutory planning instruments to the extent they are relevant to the development:
State Planning Policy;
South East Queensland Regional Plan;
Planning Regulation 2017; and
The Noosa Plan 2020.

It is noted that due to the scale of change from the existing approval the applicant has submitted a Material Change of Use for a Landing to be assessed concurrently with the subject application. The planning officer has advised that subject to conditions, they are supportive of the associated application.

The proposed changes generally comply with the requirements of the Noosa Plan 2020 and are recommended for approval
Statutory Process
The applicant has requested to make a minor change to a development approval under s78 of the Planning Act 2016. An application for a minor change to a development approval can only be made in circumstances where a change would constitute a ‘minor change’.
The proposed change to the development approval requested by the applicant is determined to constitute a minor change on the grounds that:
the development would not result in substantially different development;
the change does not include prohibited development;
the change would not require the application to be referred to an additional referral agency or cause a referral agency to have regard to new matters prescribed by regulation;
where the original application was code assessable, the change would not cause the application to become impact assessable.

The following codes from the Noosa Plan 2020 are applicable to this development:
Low Density Residential Zone Code;
Noosaville Local Plan Code;
Waterways Works  Code;
Approval Type
As the proposed amendments include a boat lifting device it is recommend that the existing approval type be amended to reflect the structures and the new scheme terminology. It is recommended that the approval be Operational Works – jetty and boat lifting device
Condition 1
Development undertaken in accordance with this approval must generally comply with the approved plans of development. The approved plans are numbered 3504-D01B as and 3504-D02B prepared by Superior Jetties and dated 15 December 2006 and as may be amended by these conditions and annotations made on the plans.
Applicant’s Request
The applicant requests that the condition be changed to reflect the amended design plans submitted.
Assessment of Request
The proposed design changes generally comply with the requirements of the Noosa Plan 2020 and are recommended for approval.
It is recommended that Condition 1 be amended to read as follows:
Development undertaken in accordance with this approval must generally comply with the approved plans of development. The approved plans are numbered 20.001-024, S01 Revision C1, 20.001-024, S02 Revision C1, 20.001-024, S03 Revision C1, 20.001-024, S04 Revision C1 and 20.001-024, S05 Revision C1 prepared by Long View Consulting Engineers dated 24 August 2021 and as may be amended by these conditions and annotations made on the plans.

Condition 6
No boatlifting devices are to be attached or moored at the jetty structure for the purpose of elevating a vessel above the water without Council approval.
Applicant’s Request
The proposal seeks approval for an existing floating boating device
Assessment of Request
The existing device is a “floating pontoon” type as described in the planning scheme. The device complies with the requirements of the scheme. As the device is indicated on the amended plans it is recommended that Condition 6 be deleted.

The proposed development generally complies with the requirements of the planning scheme and does not raise any significant issues that cannot be addressed by reasonable and relevant conditions. The application is therefore recommended for approval.

RECOMMENDATION
With regard to Application No. 142006.2191.01 , to make a minor change to an existing approval for Operational Works Transport Type 2 - Domestic Marine situated at 43 The Anchorage Noosaville Qld 4566  described as Lot  Lot 793 RP 910421, Council on 30 November 2021 decided to:
A.	Approve the change.
B.	Change the application type to
Operational Works – jetty and boat lifting device
C.	Amend condition 1 to read as follows:
Development undertaken in accordance with this approval must generally comply with the approved plans of development. The approved plans are numbered 20.001-024, S01 Revision C1, 20.001-024, S02 Revision C1, 20.001-024, S03 Revision C1, 20.001-024, S04 Revision C1 and 20.001-024, S05 Revision C1 prepared by Long View Consulting Engineers dated 24 August 2021 and as may be amended by these conditions and annotations made on the plans.
D.	Delete condition 6.
E.	Issue a “Changed Decision Notice”
