SERVICES & ORGANISATION COMMITTEE MEETING AGENDA 10 OCTOBER 2017
Following that meeting in Brisbane, King and Company were engaged to develop draft Local Law
No.7. While drafting proposed Local Law the operational criteria under the current Waste and
Recycling Regulations 2011 and the Environmental Protection Regulations 2008 were also
reviewed. The review identified that Council needs to take some initial action prior to making local
law No.7. This report proposes the action to be taken.
2. Issues to be addressed now
Section 7 - Waste and Recycling Regulations 2011 sets out in summary that Council may
define the area within the shire where:
waste and recycling collection services are provided, and
the frequency for provision of those collection services.
Council has designated the Waste Collection Area and the Waste and Recycling Collection area
on maps in the Waste Management Contract, adopted by Council. It has also designated some
waste management criteria in the Revenue Statement adopted by Council resolution. The legal
advice from King and Company advised that our current processes are not entirely satisfactory
and should be corrected.
Chapter 5A - Environmental Protection Regulations 2008 sets the broad operational
requirements for storage and collection of waste including provisions for Council to define what is
an approved standard waste container. The 2017/18 Revenue Statement adopted by Council
sets out the bin sizes that Council will provide and service charge for each service, but does not
properly define what are the approved standard waste containers.
3. Action Required by Council
King and Company encourage Council to rectify these anomalies by taking the following action:
1) Define the waste collection area and recycling collection area on maps of the shire area,
the frequency of collection of waste and recycling containers in the defined area and adopt
these criteria by Council resolution.
2) Define and describe what are the approved standard general waste containers, recycling
containers, and garden waste containers approved by Council resolution.
4. No Action Required – Garden Waste Recycling Service
There is no need to define the garden waste recycling service areas or frequency of collection of
garden waste as this has already been properly defined on maps through Council resolutions
dated 20 April 2017 (3 bin service area and optional service area) and 21 September 2017 (Lake
Cooroibah area).
5. Attachments to the report
Attachment 1 to the report shows a map defining the current waste collection area.
Attachment 2 to the report shows a map of the current recycling collection area.
Attachment 3 lists the current standard waste containers that should be endorsed for use in
Noosa Shire.
Previous Council Consideration
Reports to Council in April and September 2017 adopted the Garden Waste Service Policy and
maps designating the defined Garden Waste Recycling Service Area and Optional Garden
Waste Recycling Service Area, including frequency of collection.
