GENERAL COMMITTEE MEETING AGENDA 12 SEPTEMBER 2022
The purpose and overall outcomes of Coastal Protection and Scenic Amenity Overlay Code
state:
1. The purpose of the Coastal Protection and Scenic Amenity overlay code is to:
a. maintain coastal processes including erosion and accretion processes to enable
these natural functions to continue;
b. maintain the protective function of coastal resources including vegetation and
dunes to mitigate risks associated with coastal erosion; and
c. ensure development is designed and sited to protect the natural beach experience
and scenic amenity of the coastal area enjoyed by Noosa Shire residents
and visitors.
2. The purpose of the code will be achieved through the following overall outcomes:
a. Development allows for natural processes of erosion and accretion to occur
naturally, including as a result of sea level rise.
b. Development ensures landforms, creeks, dunes, vegetation and biodiversity in
coastal areas are not impacted by development to mitigate coastal hazard risks
and to protect environmental values; and
c. Development is designed and sited to protect the visual character and scenic
amenity of the Coastal Protection and Scenic Amenity Area and to integrate with
the surrounding natural landscape and skyline vegetation.
These relate to the maintenance of coastal processes, the natural landform and the visual
character and scenic amenity of the area. The enclosed and cantilevered part of the building
will not impact on coastal processes or the natural landform whilst the limited encroachment
will not detrimentally impact the scenic amenity of the area.
The existing vegetation on site means that the neighbouring property to the south does not
enjoy views over the part of the site that the building extends beyond the coastal building
line. Therefore, the enclosed cantilevered portion of the building that extends within 3 metres
of the coastal building line will not impact the view lines of the adjoining premise.
Whilst the proposed building, including the cantilevered section, will be visible from the beach
this is not out of character with the surrounding area. Many dwellings are clearly visible from
the beach, some of these buildings are white and highly visible and extend a significant
distance east of the coastal building line. In contrast the subject dwelling is setback further
from the rear boundary and will consist of natural tones. Significant vegetation on the steep
dune located within the adjacent foreshore reserve will provide some screening of the
development from varying vantage points. Having regard to the existing built form and
vegetation within proximity of the site enclosing the cantilevered portion of the dwelling will
not detrimentally impact on the scenic amenity of the surrounding area.
The following photos detail the subject site and surrounding area as viewed from the beach.
