Officer :Jack Lewis Direct Telephone: 07 53296236 Fax: Our Reference :JLEWIS:JLEWIS: Your Reference :N/AN/A 19 October 2015 Coastal Building Certifications Pty Ltd PO Box 890 BUDERIM QLD 4556 Dear Sir/Madam Information Request Sustainable Planning Act 2009 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No: MCU15/0096 Proposal: Development Permit for Material Change of Use – Detached House Street Address: 50 Seaview Tce SUNSHINE BEACH QLD 4567 Real Property Description: Lot 61 RP 81810 Planning Scheme: The Noosa Plan (16 September 2013) information required The information requested is set out below: Coastal Protection The Outcomes of the Natural Resources - Coastal Protection Area seeks for new buildings and structures do not extend seaward of the coastal building line. It is acknowledged there is an existing pool adjacent to the rear boundary which is not proposed to be removed and the new house is being setback further than the existing house. However, no additional development shall be located within this rear setback area. Information Required In accordance with the Outcomes of the Overlay Code please amend the plans by: Removing the ‘day bed’ structure near the rear of the property; Deleting the stairwell and gates to the fore dune; and Provide additional landscaping between the pool and the side and rear property boundaries (Note these should be suitable coastal beachfront species in accordance with PSP3 – Landscaping, Plants & Guidelines). Roof Top Terrace The terrace area accessible from bedroom 2 & 3 is considered a roof top terrace and creates the opportunity for residents to overlook the private open spaces of neighbouring properties. Information Required Please amend the plans by either removing the roof top terrace area, or significantly reducing the size of the terrace and providing view shed diagrams showing that the terrace will not create opportunities for residents to overlook the private open spaces of the neighbouring properties. Landscaping & setbacks The Detached House Code seeks for structures to be setback a minimum 6m from the front property boundary. The proposed plans have the building setback only 2.29m from the frontage. Information Required Please either amend the plans to comply with the setback requirements, or provide appropriate justification as to why the setback relaxation is acceptable in the context of the street and how any landscaping is being retained on the site and within the road reserve, which will enhance the visual pattern of the street. The justification should include appropriate renders of the building with any proposed landscaping elements. End of Information Request Under the provisions of the Sustainable Planning Act 2009, you have three options available in response to this Information Request. You may give the assessment manager (in this instance Council) and each referral agency (if any): all of the information requested; or part of the information requested together with a letter asking the assessment manager and each referral agency to proceed with the assessment of the application; or a letter; stating that you do not intend to supply any of the information requested; and asking the assessment manager and each referral agency to proceed with the assessment of the application. Please be aware that under Section 279 of the Sustainable Planning Act 2009 the applicant must respond to the Information Request within 6 months of the request or otherwise the application lapses.
