PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014
3. ASSESSMENT
3.1. Preliminary Approval Assessment Framework
The assessment for a Preliminary Approval under Section 242 of the Sustainable Planning Act
2009 must have regard to the relevant State and local planning instruments, the effect the
proposed variations would have on any right of a submitter for following applications, and any
referral agency response.
The application must also demonstrate there are sufficient grounds in the public interest to
approve the development despite the inconsistency with the Planning Scheme. Further comment
about the applicant’s grounds is provided in section 3.3.
3.2. State and Other Statutory Instruments
State Planning Policy
The proposal meets the Interim Development Assessment requirements as described in Part E of
the State Planning Policy (July 2014).
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Urban Footprint of the SEQ Regional Plan. The proposal is
consistent with the regional policies of the SEQ Regional Plan.
State Planning Regulatory Provisions
The South East Queensland (SEQ) Regional Plan Regulatory Provisions apply to the application.
The proposal is for an urban activity within the Urban Footprint and is consistent with the SEQ
Regional Plan Regulatory Provisions.
The SEQ Koala State Planning Regulatory Provisions are not applicable to the site.
3.3. The Noosa Plan
The site is located in the Cooroy & Lake Macdonald Locality and is zoned Community Services.
The proposal to subdivide and develop detached houses on the lots is inconsistent with the zone
provisions and is required to follow an impact assessable application process.
Cooroy & Lake Macdonald Locality Provisions
The relevant Overall Outcomes for the Cooroy & Lake Macdonald Locality Code applicable to the
development are outlined below:
b) The Cooroy and Lake Macdonald Locality support a growing urban and rural settlement of
permanent residents;
k) The town of Cooroy provides a range of community services, schools, medical facilities,
sporting and recreational facilities, which service the hinterland and beyond;
x) For the Community Services Zone—land committed or planned for community
purposes—
i is protected and managed to enable the efficient and timely delivery of community
services; and
ii is consistent with the indoor recreation, education, health, social and safety needs of
the local community, including people with special needs, such as the elderly,
children, low-income earners and disabled persons;
The applicant contends that there are sufficient grounds to approve the application despite the
inconsistency, as the zoning does not reflect the changing circumstances relevant to the
surrounding area, including:
The Community Services zoning is no longer needed to protect the site for use as a gravel
reserve;
