PLANNING & ORGANISATION COMMITTEE MEETING AGENDA 9 DECEMBER 2014
3. ASSESSMENT
3.1. Instruments for Statutory Assessment
Under the Sustainable Planning Act 2009 the application must be assessed against each of the
following statutory planning instruments to the extent they are relevant to the development:
State Planning Policies;
the South East Queensland Regional Plan;
State Planning Regulatory Provisions;
the Planning Scheme for the local government area; and
any Temporary Local Planning Instrument in place for the local government area.
Of these, the statutory instruments relevant to this application are discussed in the sections that
follow.
3.2. State and Other Statutory Instruments
State Planning Policies
The application is consistent with the interim development assessment requirements of the State
Planning Policy 2014.
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Regional Landscape and Rural Production Area of the SEQ
Regional Plan. Assessment against the SEQRP regulatory provisions are not triggered because
the proposed short-term accommodation is for less than 300 people. The proposal is otherwise
generally consistent with the regional policies of the SEQ Regional Plan.
3.3. Planning Scheme – The Noosa Plan
The subject site is located in the Cooroy and Lake Macdonald Locality and is zoned Rural under
The Noosa Plan. The planning scheme does not currently list an RV stop as an identified land
use. A caravan park is the most comparable defined use but is associated with communal
facilities and the right to include cabins and the like. As such, it is considered appropriate that
the use is deemed undefined and subject to an impact assessable application process.
Locality Provisions
As the use is undefined, it is not specifically contemplated or provided for in the Cooroy and Lake
Macdonald Locality Code’s provisions for the Rural zone. However, the Code does provide
some guidance for the assessment of new uses in rural areas. The primary considerations for
new uses under the Code are:
Whether the use can operate on the site while maintaining the amenity of surrounding
residents
Whether the use can avoid reverse amenity impacts on the lawful operation of the quarry
on adjacent land if it recommences
Whether the use has locational requirements that support its establishment on the
proposed site
These are discussed in the following section.
Land Use, Works and Overlay Provisions
The following codes are most applicable to this application:
Visitor Accommodation Code
Engineering Works Codes
Landscaping Code
