Officer: Patrick Murphy Direct Telephone: 61753296436 Our Reference: MCU18/0157 Your Reference: n.a 14 March 2019 Boiling Pot Brewery C/- Pivotal Perspective Pty Ltd 4/59 Mary St NOOSAVILLE QLD 4566 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. MCU18/0157 Street Address: 130 Eumundi Noosa Rd Noosaville Qld 4566 134 Eumundi Noosa Rd NOOSAVILLE QLD 4566 Real Property Description: Lot 6 RP 173876 Lot 5 RP 173876 Planning Scheme: The Noosa Plan (8 June 2018) INFORMATION REQUIRED The information requested is set out below: Issue Concerns regarding the parking layout in relation the functioning of a number of parking spaces and compliance with the applicable Australian Standard (AS2890.1). Information Required Provide updated layout for the parking areas to address the following: Vehicle manoeuvring for carpark spaces 1, 2 and 18 of the south parking area (on No 134 Eumundi Noosa Road). Amendments to carpark spaces 12 and 13 of the south parking to comply with Blind aisles requirements in compliance with Section 2.4.2 (c) and Figure 2.3 of AS2890.1. Parking space 7 for staff of the north parking area should not be in tandem with a customer parking space (No 5). Issue Concerns regarding the grades and levels of the driveway from Project Street to the south parking particularly in relation to the finished levels of proposed parking spaces 1, 2 and 10. Information Required Provide the following information: Provide longitudinal cross section and finished levels for the driveway starting from the kerb line and to a minimum distance of 20m into the site or up to carpark space No 4. The finished levels for carpark 1, 2 and 10 and identifying any required earthworks and retaining walls for constructing these spaces to match the levels of the driveway. Issue A general stormwater management plan for proposed south parking area on 134 Eumundi Noosa Road is required. Information Required Provide a general stormwater management and disposal plan for the south parking area. Issue A lease is proposed with the adjoining property owner at 134 Eumundi Noosa Road to facilitate access to 9 car spaces. Details of the lease are unclear. Information Required Details of the lease agreement with the adjoining property owner including the period of the lease. It is preferred that a copy of the proposed lease be provided. Issue Works undertaken adjacent to the Project Avenue frontage include the addition of retaining wall and associated balustrade. These works have compromised the opportunity to provide a landscaped setback to Project Avenue. Information Required Details of a compliant landscaped setback to Project Avenue. Issue The proposal recognises that the use of the 9 car parking spaces at 134 Eumundi Noosa Road may be relinquished and proposes that the area associated with on-site consumption of food and alcohol be limited to the 60m2 internal dining area as detailed on the approved plan. It is noted that the amount of car parking proposed at 130 Eumundi Noosa Road does not comply with the Driveways and Car Parking Code, even with the area associated with on-site consumption of food and alcohol limited to the 60m2 internal dining area as detailed on the approved plan. The amount of car parking provided on 130 Eumundi Noosa Road and the proposed tenure arrangement with 134 Eumundi Noosa Road are a concern. Furthermore, the planning report dated 26 February 2019 includes an analysis of the use areas of the development. It appears that the purpose of the analysis is to provide justification that the areas associated with the non-industrial use are subordinate to the industrial use. The relevant table includes the truck manoeuvring and loading area (60m2) in the calculation of the industrial use, it is also noted that the Total use area and Industrial use areas detailed in the table are not reflective of the itemised areas. The definition of use area in the Noosa Plan excludes the areas used for access, parking and associated manoeuvring of vehicles. Truck manoeuvring and loading area must therefore be excluded from this analysis. It is also noted that the analysis includes the boardroom and office within the industrial use, these areas should not be included in the calculation of the industrial use area. Furthermore it is unclear as to why the upstairs male toilets have been included within the calculation of the industrial area when they are to be used by patrons of the proposed bar. Rectification of the above matters results in a reduced industrial area and raises significant concern with the extent of area dedicated to non-industrial uses. You may wish to provide a written response to these concerns. due date for response to information request The due date for providing the requested information is 14 June 2019.
