PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 FEBRUARY 2020
E. To note that each of Administration (Amendment) Local Law (No. 1) 2019 and Administration
and Other Subordinate Local Law (Amendment) Subordinate Local Law (No. 1) 2019 contain
anti-competitive provisions;
F. To bring forward the consolidated version of:
a. Local Law No. 1 (Administration) 2015;
b. Subordinate Local Law No. 1 (Administration) 2015; and
c. Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and
Roads) 2015;
for adoption and commencement in early 2020 to enable the local law amendments to
commence when the new Noosa Plan takes effect.
Finance
There are minor costs associated with public notification and advertising. These costs are being
managed within existing budgets.
Subordinate Local Law No. 1 (Administration) 2015 requires an application for approval for pylon,
pole, freestanding and illuminated signs. There is a one off fee associated with the application
process.
The fees proposed for the sign applications required by the local law are:
Pylon sign, pole sign, freestanding sign - $150 per sign
Illuminated sign - $100 per sign
The proposed application fees are cost recoverable and based on the anticipated cost of receipting
and assessing an application and issuing an approval under the local law.
Risks & Opportunities
Consolidated versions of the local laws need to be adopted and in place at the commencement of
the new Noosa Plan to ensure the continued regulation of advertising devices.
There is a risk the local law amendments will take effect prior to the commencement of the new
Noosa Plan if the Minister’s approval delays the new Noosa Plan’s adoption by Council.
If this occurs, the current Noosa Plan will prevail over the local law where duplication arises
between the provisions relating to permanent signage which is currently regulated by The Noosa
Plan.
There will be no duplication for temporary signage which is currently already regulated by local
laws.
Consultation
External Consultation - Community & Stakeholder
Further communication will occur advising the community and stakeholders of the commencement
of the advertising device amendments will be undertaken leading up to and after the 28 February
2020, including:
Notices in Noosa News, on Council’s website and Facebook
Email notification to stakeholders and submitters
Fact sheets
Internal Consultation
Internal consultation will be undertaken across Council advising of the proposed amendments and
adoption of the consolidated versions.
