2. BACKGROUND
The site comprises lots 10 and 11 of Residential High Density lots created under development

The original approval established the following:
• A combination of Residential High Density and Detached Housing allotments;
• Developable areas within those lots, with retained vegetation and environmental corridors
within lots protected under covenants; and
• Public conservation land dedications of approximately 20Ha of significant environmental
areas.

In 2008, Council considered an application for a Material Change of Use of Premises (Resort
Development comprising Multiple Dwelling – 109 Dwelling Units) and Accommodation Building (90
Accommodation Units) and Ancillary Facilities over lots 10 and 11 under a Superseded Planning
Scheme (1985 scheme) which was approved by Council on 8 April 2010.
21 properly made submissions and 6 not properly made submissions were received in response
to advertising of the application. The submitters were concerned with a number of aspects of the
development including its scale, location, traffic and access, pedestrian paths, the environment
including habitat trees and, noise impacts. A submitter appeal was lodged against the Council
approval, with a Court Order subsequently issued on 14 October 2011 approving the development.
