Noosa Council documents
Service by post has been chosen because the material relied upon by Council
is already voluminous and there are 94 lot owners to serve. In addition to the
above material, Council will rely on affidavit material. A copy of this material is
available at your election either:
1) By requesting it to be sent to you via a PDF attachment to an email by
sending your request to [email protected]
2) by telephoning 5449 5286 and speaking to Nicolle Teubler to arrange for
a package containing either a compact disk or a hard copy
i) to be collected by you from the Council Office at 9 Pelican Street,
Tewantin Q 4645 or
ii) to be posted to you or your lawyer.
The matter is to return to Court next on 22 March 2013. This is to allow
sufficient time for the respondent parties to determine how they wish to
proceed next.
It is not necessary for you to appear in Court or to engage a lawyer however
you will be bound by any orders the Court eventually makes even if you do not.
The Body Corporate and resort manager have been served as parties to the
application. You may wish to contact the Body Corporate or other owners with
a view to determining what level of participation and representation you each
wish to have in the matter. Council is not able to provide you with legal advice.
The Court has ordered that any party who wishes to have any further material
served on them provide an email address to allow that to happen. This is
because every party must serve a copy of every document on every other party
and it is likely to be too expensive, slow and cumbersome to proceed in any
other manner. If you wish to be served in another manner you may make
application to the Court for a direction to that effect on the return date.
If you do not wish to take an active role in the proceedings, please contact the
Council using the email address or phone number listed above to let us know.
Regardless of how you chose to take part in the proceedings, a copy of any
final orders will be sent to you by email if you have been an active party or by
post if you have not.
