1 Introduction
1. This Town Planning Report has been prepared in support of a Code Assessable Development Application
for a Material Change of Use to establish Multiple Dwelling (3 units). This documentation has been
prepared by ADAMS + SPARKES Town Planning (hereafter; ‘ADAMS + SPARKES’) for and on behalf of the
applicant, Fastwin Investments Pty Ltd, over land at 31 Tewantin Road, Cooroy, legally described as Lot
106 on C5604.
2. The local government, which applies to the subject site is the Noosa Shire Council. In accordance with
Schedule 8 of the Planning Regulation 2017, the Noosa Shire Council is the Assessment Manager of the
Development Application. The applicable planning scheme is the Noosa Plan 2020 (hereafter ‘the
planning scheme’). Under the planning scheme the proposed land use is best defined as ‘Multiple
Dwelling’, which is specifically defined as follows:
‘Multiple Dwelling’
means a residential use of premises involving 3 or more dwellings, whether attached or detached,
for separate households.
3. The subject site is located within the Medium Density Residential Zone and the Cooroy Local Plan Area.
In accordance with Part 5.5.2 - Table of Development Assessment in the Medium Density Residential Zone,
the Development Application is subject to Code Assessment.
4. This Town Planning Report will describe the site, the proposed development, and address the relevant
Town Planning and design issues with respect to the proposal. This report should be read in conjunction
with the following supporting documentation:

3 Proposed Development
3.1 Pre-lodgement Meeting
6. A Pre-lodgement Meeting was held on 16 August 2022 with Noosa Council’s Town Planning and
Engineering staff, in which in-principle support was given for the proposal.
7. Overall, the proposed building design and site layout were supported by Council, inclusive of the
proposed second driveway crossover to Olivine Lane. Council, however, raised issues with the use of
particular building materials, including stonewall cladding. As such, these aspects have been removed
from the building design and replaced with lightweight timber/cladding features that better represent
the traditional Queensland vernacular and the rural town character of Cooroy. Further, Council sought a
greater extent of roof overhang (600mm eaves) to be incorporated into the design and emphasised the
importance of meeting the setback, plot ratio and site coverage outcomes prescribed by the planning
scheme. The lodged design achieves full compliance in this regard, as clearly demonstrated by the
Proposal Plans prepared by Ausmar Homes in Appendix 2.
8. Council also detailed the requirement for frontage works and a 2 metre wide land dedication to Olivine
Lane. It is proposed to fulfill this obligation, with Civil Engineering drawings for the required roadworks
to be submitted under a subsequent Operational Works application. Finally, changes to the location of
the visitor car park have been made in response to Council feedback, in which Council suggested adopting
the outcome approved for #33 Tewantin Road to the north. This included locating the visitor parking bay
within the front landscape buffer area adjacent to Olivine Lane.
3.2 Proposal Overview
9. Please refer to the Proposal Plans prepared by Ausmar Homes in Appendix 2. It is proposed to construct
three (3) Multiple Dwelling units onsite, comprising a detached Dwelling unit fronting Tewantin Road and
two (2) attached Dwellings fronting Olivine Lane. All units will be constructed over two (2) storeys, with
three (3) bedrooms, ample private open space and two (2) garaged resident car spaces each. A visitor car
park will be provided adjacent to the Olivine Lane street frontage.
10. Tables 2 and 3 below provide an overview of the key development parameters associated with the
development and confirms that the development complies with the key Acceptable Outcomes of the
relevant Planning Scheme codes.

Figure 2 Site Plan (Source: Ausmar Homes 2022)
12. As shown in Figure 2 above, Unit 1 will be accessed via the existing crossover from Tewantin Road, with
Units 2 and 3 being provided with a new shared access to Olivine Lane. All car parking areas provided
onsite comply with the Australian Standards and the site layout ensures that adequate vehicle
maneuvering area is provided onsite for cars to enter and exit in forward gear. Finally, it is proposed to
provide a 2 metre wide land dedication to Olivine Lane to facilitate the widening of the laneway to match
the works completed by the adjoining site to the north.
ASTP Ref: 220219 Page 8 of 16
Page 9
13. Civil Engineering drawings for the proposed access, parking and roadworks design will be submitted to
Council under a subsequent Operational Works application upon receipt of a Development Permit for the
Material Change of Use.
3.3 Architectural Design and Built Form
14. As illustrated in Figures 3 and 4 below, and by the Proposal Plans in Appendix 2, the development
features a traditionally inspired built form with references to historical Queensland style architecture.
The high-quality design comprises articulated box gable and hipped roof forms, which will be finished
with metal sheeting. Further, the external walls present a mix of building materials and finishes, including
paint finish lightweight horizontal cladding, rendered finish panel cladding and ample window glazing.
Finally, the upper level balconies are provided with vertical timber balustrading.
15. Steps, projections and recesses are evident in the building facades to enhance visual interest, which are
created by the building layout, extended roof eaves and the incorporation of unenclosed porch and patio
areas. Further articulation of the external walls is created by the inclusion of ample window and glazed
door openings, which offers a combination of window types, shapes and positions to break up the
appearance of blank walls.
16. The final colour scheme will feature understated tones, largely consisting of white and Basalt grey.
Overall, the proposed development encompasses a purposeful building design intent to reflect the
traditional character of the local area, which is described within the Planning Scheme as having a ‘country
town feel’.

3.4 Landscaping
17. Soft landscaping has been provided along all site boundaries, with the frontage landscapes providing
visual relief to the built form, assisting in providing microclimatic control and generally making a positive
contribution to the streetscape, whist still maintaining casual surveillance to and from the street. The
proposal includes 473.51m² of landscaping onsite and exceeds the soft landscaping requirements under
AO10.1 of the use code.
18. The front setback area is provided as landscaped open space with the visitor car park setback more than
2m from the front boundary. Further, front fencing is not proposed to be provided onsite. With the
existing crossovers being retained, all existing street trees will be retained to continue the street tree and
streetscape character.
19. Detailed landscape design drawings will be submitted to Council under a subsequent Operational Works
application upon receipt of a Development Permit for the Material Change of Use.

4 Statutory Framework
20. This section of the Town Planning Report describes the statutory planning framework applicable to the
proposed development.
21. Table 4 below outlines the applicable State Mapping Triggers, which require consideration as part of this
Town Planning Report. In addition to this, Table 4 details whether the application requires referral to any
Referral Agencies.

4.1 State Planning Policy
22. Section 2.1 of Council’s Planning Scheme indicates that the Planning Minister is satisfied that the relevant
State interests in the July 2017 version of State Planning Policy (SPP) is appropriately integrated in the
planning scheme with the exception of the erosion prone areas mapping. The site is not impacted by the
SPP erosion prone areas mapping. No further assessment of the SPP is necessary on this basis.
4.2 South East Queensland Regional Plan 2017
23. The site is subject to the South East Queensland Regional Plan 2017. Section 2.2 of the Planning Scheme
confirms that the Planning Minister has identified that the planning scheme appropriately advances the
South East Queensland Regional Plan 2017 as it applies to the planning scheme area. No further
Assessment against the regional plan is necessary.
4.3 State Interests (State Assessment Referral Agency)
24. A review of the above mapping against Schedule 10 of the Planning Regulation 2017 confirms that the
application requires referral to the State for making a Material Change of Use on a premises within 25
metres of a State-controlled Road. The referral will be made to SARA upon receipt of a Confirmation
Notice from Council.
25. The subject site will retain the existing residential driveway access from Tewantin Road for one (1)
Dwelling unit. This arrangement is unchanged from the current circumstance.

5.1 Assessment of Development Application
27. As part of this development application, the following codes have been addressed below:
• Cooroy Local Plan Area Code
• Medium Density Zone Code
• Dual Occupancy and Multiple Dwelling Code
• Works Codes:
o Driveways and Parking Code
o Earthworks Code
o Existing Services Code
o Fire services for common private title Code
o Landscaping Code
o Sustainable Building Design Code
o Transport Code
o Water Quality and Drainage Code
o Waterways Works Code
o Waste Management Code
28. The proposed development generally complies with the Acceptable and Performance Outcomes of all
applicable codes. The pertinent issues identified throughout the assessment of the application are
detailed below. Where the below sections are silent in relation to an assessable element, the
development is seen to comply with that relevant assessment criteria and no further assessment is
required.
5.2 Cooroy Local Plan Code
29. The proposed development complies with all relevant provisions of the Local Plan Code, with the
provisions of key relevance to the proposal discussed in detail below. It is noted that the site is not
mapped as containing any relevant Local Plan features on Figure 7.2.2.4.
30. AO4 seeks for development adjacent to Tewantin Road to incorporate landscaping that complements the
natural species occurring in the local area, protects existing vegetation within the road reserve and
incorporates design elements that add visual interest to the streetscape. With the existing access
point/driveway crossover being retained on this frontage, the proposed development can maintain all
existing street trees in the verge along Tewantin Road. Further, the development can be conditioned to
populate the 2 metre wide front landscape strip adjacent to Tewantin Road with species that are native
ASTP Ref: 220219 Page 12 of 16
Page 13
to the area. Additionally, the development features a high-quality design with articulated gable and
hipped roof forms, a mix of lightweight external building materials and steps and recesses in the building
facades, which overall references the natural and built form character of the local area. The proposed
development complies with AO4 on this basis.
31. AO7.2-AO7.6 seek built forms that reflect traditional Queensland styles, with pitched roof forms that are
visible to the streetscape, lightweight external building materials and open verandahs/balconies, as well
as site layout design that allows for landscapes between buildings. As illustrated by the Proposal Plans in
Appendix 2, the proposed development incorporates the aforementioned traditional building design
elements, inclusive of the preferred roof forms and a predominant use of lightweight horizontal cladding
to the external walls of the building. Further, the development provides extended roof eaves, covered
entry porticos and open balconies with timber balustrades, as evident in traditional ‘Queenslander’
homes that respond to the subtropical climate. Finally, soft landscaping has been provided along all site
boundaries, with the deep planted frontage landscapes. Space is also provided between the buildings
onsite and along the site boundaries to allow trees to be planted.
32. The Cooroy Local Plan Code also includes Performance Outcomes (PO16-PO18) that are relevant to the
function of laneways in the area. As such, the proposed development is required to support the role of
Olivine Lane to provide access to sites in a way that relieves traffic along Tewantin Road and supports
pedestrian connectivity. This is achieved by delivering a 2 metre wide land dedication to facilitate the
widening of Olivine Lane and upgrading the external road to a standard that complies with the Planning
Scheme.
33. Overall, the proposed development complies with the relevant aspects of the Cooroy Local Plan Code.
5.3 Medium Density Residential Zone Code
34. A full assessment against the Performance Outcomes and Acceptable Outcomes of the Medium Density
Residential Zone Code has been provided in Appendix 3 and demonstrates that the development
complies with all applicable Assessment Benchmarks of the Code. The only area of non-compliance with
the Acceptable Outcomes of the Code relates to AO15.2, which is discussed in section 5.3.1 below.
5.3.1 Acceptable Outcome AO15.2 – Dual garages facing the street
35. As shown on the Proposal Plans in Appendix 2, the Unit 2 and 3 garages facing Olivine Lane are not
staggered and are separated by a 1.2 metre section of rendered wall, as opposed to the preferred 2
metres. The garages are not found to dominate the street or the overall building design on the basis that
their width does not exceed 4.5 metres wide and that they are recessed below the upper level balconies
of the associated Dwellings. Further, the glazed front doors, covered porticos and projecting blade walls
that create the building entrances to the sides of each garage articulate the ground level of the building
to further reduce the visual impact of the garages facing Olivine Lane. Overall, the proposal complies with
PO15 of the Code and no further assessment is required in this regard.
5.4 Dual Occupancy and Multiple Dwelling Code
36. A full assessment against the Dual Occupancy and Multiple Dwelling Code has been provided in Appendix
4 and demonstrates that the development complies with all applicable Assessment Benchmarks of the
Code, with no departures from the Acceptable Outcomes proposed.
ASTP Ref: 220219 Page 13 of 16
Page 14
5.5 Driveways and Parking Code
37. The number of car parking spaces, motorcycle spaces, bicycle spaces and loading bays has been provided
in accordance with Table 9.4.1.4 - Minimum parking requirements including end of trip facilities. The
development provides two (2) covered car parking spaces per dwelling and one (1) additional visitor car
space as required. The table does not identify any requirement to provide motorcycle spaces, bicycle
spaces or loading bays. In any case, bicycles could be stored within garages or within private open space
areas and the driveway is of sufficient dimensions to facilitate infrequent access for moving trucks. With
turning bays provided in each driveway, vehicles can enter and exit the site in forward gear. The proposed
development complies with the Driveways and Parking Code on this basis.
5.6 Earthworks Code
38. The Earthworks Code will be assessed at Operational Works stage as part of a subsequent application to
Council. It is noted that the cut/fill works onsite will not result in a change to ground level of more than
1.5 metres anywhere across the site.
5.7 Existing Services Code
39. The development will be connected to all essential urban infrastructures. The proposal is for infill
development within a well-established and well serviced locality therefore maximising the efficient use
of existing infrastructure. All works and connections to infrastructure will be undertaken in accordance
with the relevant Planning Scheme Policies, Unitywater requirements and other service provider
requirements. The proposed development suitably complies with the Existing Services Code.
5.8 Fire Services for Common Private Title Code
40. The Fire Services for Common Private Title Code will be assessed at Operational Works stage as part of a
subsequent application to Council.
5.9 Landscaping Code
41. Detailed landscape design drawings will be submitted to Council under a subsequent Operational Works
application to demonstrate compliance against the Landscape Code.
5.10 Sustainable Building Design Code
42. Each unit is provided with large building openings to capture prevailing breezes and maximize natural
ventilation and cross breezes. Further, extended roof eaves and covered balconies are proposed to shade
building facades and provide protection to building openings during weather events. All units are also
provided with private open space areas that have a desirable north-eastern orientation. Overall,
sustainable building design has been carefully considered in the proposed development.
43. The proposed development can largely be conditioned to comply with the remaining aspects of the
Sustainable Building Design Code, with the stormwater harvesting and landscape provisions of the Code
able to be assessed as part of a subsequent Operational Works application. It is noted that the proposal
dedicates 473.51m² of the site to landscaping (46.78%) and in turn minimises hard surface areas that
reflect or store heat. This landscaping extent will include shade trees, particularly along the street
frontages, with the proposed species intended to be detailed at Operational Works stage.
5.11 Transport Code
44. The development is not of a scale that would unreasonably impact the operation of Tewantin Road, with
the existing access driveway proposed to be retained for one (1) unit only. All resident vehicles can enter
ASTP Ref: 220219 Page 14 of 16
Page 15
and exit the site in a forward gear, so as to not compromise the safety and efficiency of the road network,
with turning bays provided at each end of the site. Finally, the site’s location supports the use of public
and active transport modes.
45. As detailed above, it is proposed to provide a 2 metre wide land dedication to Olivine Lane to facilitate
the widening of the laneway to match the works completed by the adjoining site to the north, as required
by the Local Plan Code. Civil Engineering drawings for the proposed access, parking and roadworks
designs will be submitted to Council under a subsequent Operational Works application upon receipt of
a Development Permit for the Material Change of Use. These works will be delivered in accordance with
the Transport Code and relevant Planning Scheme policies.
5.12 Water Quality and Drainage Code
46. It is proposed to provide details of the stormwater quality and quantity management solution as part of
a subsequent Operational Works application upon receipt of a Development Permit for the Material
Change of Use.
5.13 Waterways Works Code
47. The development does not involve any works within or immediately adjacent a waterway. The provisions
of the Waterway Works Code are not considered to be applicable to the proposed development.
5.14 Waste Management Code
48. Each unit has been provided with sufficient area in the private open space to store individual waste bins.
These bins will be screened by private open space fencing and will be serviced from the kerbside. The
distance between the waste storage areas and the kerbside is less 60 metres (approximately 10m) as
required by AO3.3 of the code. The proposed development complies with the Waste Management Code.
ASTP Ref: 220219 Page 15 of 16
Page 16
6 Conclusion and Recommendations
49. This Town Planning Report demonstrates that approval of the proposed development is warranted,
subject to reasonable and relevant conditions, on the following basis:
