Re: Request to Change Development Approval s369 of the Sustainable Planning Act 2009 (SPA) - Development
Permit for Material Change of Use (Noosa Springs Precinct F - 155 Multiple Dwelling Units and Associated
Facilities – Theatre, Restaurant, Shops & Function Rooms) over land at Leslie Drive, Noosa Heads and described
as Lot 7 on SP178340 (previously Lot 3 on SP221524) – Council Ref: 2005/1133)
Dear Kerri,
On behalf of our client, Altum Properties No. 4 Pty Ltd, we hereby submit a request to change the existing
development approval under s369 of SPA. Our client has recently entered into a contract to purchase the site and
is within the “due diligence” period.
Specifically, we are seeking to change Condition 20 relating to the currency period for the approval. We note that
a previous extension to the currency period was issued by Sunshine Coast Council on 6 April 2011, to extend the
currency period to 1 November 2015.
Given the requirement to obtain detailed engineering/op works approvals and building approvals, along with
construction timeframes, it is unlikely that commencement of the use would occur prior to 1 November 2015.
We therefore seek a further 2 year extension to the currency period until 1 November 2017.
Our extension request is based on the following grounds:
the economic climate has resulted in the site remaining vacant under the existing approval obtained by
the previous applicant, Starco Developments Pty Ltd;
the previous applicant subsequently elected to sell the site with development approval still current, albeit
with only 6 months remaining until the approval;
there are no other changes proposed to the conditions of the approval, or the approved drawings as part
of this request;
the proposal remains consistent with the overall outcomes of the Semi-Attached Housing Zone as
provided in the Noosa Heads Locality Plan in that it provides for residential accommodation in detached
and semi-attached housing forms that offer a high level of residential amenity, design quality and safety,
and respect the domestic scale of surrounding development; and
the proposal is a consistent use within the Semi-Attached Housing Zone as provided in Table 9.13 of the
Noosa Heads Locality Plan in that the site has an area greater than 800m2.

In light of the above, we argue that the request to extend the relevant period by a further 2 years is not
unreasonable and is warranted under the circumstances.
We advise that a copy of this extension request has been forwarded to SARA for concurrence agency assessment
and response.
If you require any further information regarding this development application, please contact Leanne Simpson via
phone or email [email protected] to discuss.
Yours faithfully,
