A.White Kabi Submission
Attached to the e-mail PM Submission - Aaron White - 131998.981211.5.
Noosa Shire Council PO Box 141 Tewantin QLD 4565 By email: [email protected] Date: 22 April 2023 Re: Public Consultation for Application Ref: 131998.981211.5 Change proposed to a “Development Permit for Other Change to include an Undefined Use (Group Farm Stay Accommodation and Associated Infrastructure)” at 59 Kabi Road, Cootharaba: Lot 394 on M371117, Lot 7 on RP216403 and Lot 650 on M37380 To whom it may concern, I write regarding the above Christian Youth Council (CYC) application to establish a 300-person (maximum) accommodation facility on the previous Kabi Golf Course and Orchard (Kabi) site. 1. In the first instance, I am requesting Council recommend for refusal of the application on grounds the applicant failed to sufficiently address the matter of the ‘Existing Approval’ being lapsed in 2011, when the Kabi operation closed and ceased its “Use” as described in the original Decision Notice and Town Planning Conditions. 2. CYC’s formal 31 March 2023 Noosa Today public notification advertisement claims an: “Existing Approval: Integrated Permaculture Designed Organic Orchard and Golf course Complex (18 Holes)” 3. I note in March 2022, Council raised the lapsed approval issue with CYC regarding Conditions 43 and 54 of the original approval: (43) The approval of the Sport and Recreation (golf course) component of the Integrated Permaculture Designed Organic Orchard and Golf Course Complex, is only valid for as long as the Agriculture use (Permaculture) is undertaken on the site. The Sport and Recreation (Golf Course) use, and ancillary uses, lapse if the Permaculture use ceases on the site. (54) This Development Permit for a material change of use of premises lapses if:- (54.2) the use of any premises pursuant to the Development Permit ceases. 4. I refer to the following claims made by CYC in their Pivotal Perspective “Development Application Planning Report”: “There is absolutely no question that the permaculture use has NOT ceased as the orchard is not something that suddenly stops operating, but continually produces fruit/vegetables. In addition, free range poultry and beef have continually grazed which is part of the permaculture system, to integrate livestock and crops. The orchard and gardens have continuously been maintained over the years and the organic produce sold locally or to market. The permaculture use has never ceased. In terms of the golf course use, the course and greens have been mowed up to 2 times per week and the bunkers maintained since the use commenced. If the use was not operating, why would this occur at great cost to the owner. Furthermore, if the use had ceased, the area of the golf course would either be returned to pasture or be regenerated under the permaculture system”. Page 1 of 10
