EXECUTIVE SUMMARY
This report seeks Council’s final adoption of its new Planning Scheme (Noosa Plan 2020),
approved by the Minister for State Development, Manufacturing, Infrastructure and Planning.
The current planning scheme for Noosa Shire dates back to 2006, and while having been amended
several times was made under previous planning legislation. Since 2016 Noosa Council has been
working towards the adoption of a new planning scheme and the final version now presented is a
result of extensive community input over a number of years, review and input from various State
agencies, and comprehensive and extensive consideration at all stages of its preparation by
Council.

Special Meeting dated 16 July 2020; and
A. Adopt the Noosa Plan 2020 as amended as a result of State Interest Review and Ministerial
Conditions, as per attachments 2 – 22 of the report;

to commencement;
D. Publicly notify adoption of the scheme in accordance with requirements of the Planning Act;
and
E. Provide the Chief Executive of Department State Development, Manufacturing, Infrastructure
and Planning a copy of the public notice.
REPORT
1. Second State Interest Review
On 12 December 2019 Council sought Ministerial endorsement of the new Planning Scheme.
Following this, Council officers spent considerable time with officers of the Department of State
Development, Manufacturing, Infrastructure and Planning, responding to their questions about the
scheme and refining the content of the draft scheme in response to State considerations.
Council at its meeting of 11 December 2019 authorised the CEO to make any minor changes to
the Noosa Plan 2020 prior to sign off by the Minister for adoption. Accordingly, there were a
number of administrative corrections made for accuracy and usability.
All changes made to the draft scheme since Council adoption on 11 December 2019 are itemised
in Attachment 1 – Edits made since December 2019 – as a result of 2nd State Interest Review and
Ministerial Conditions. Some of these are particularly minor in nature however some do represent
a shift in policy.
2. Ministerial approval subject to Conditions
On 18 February 2020 Council received advice from the Minister for State Development,
Manufacturing, Infrastructure and Planning that he is satisfied Council may proceed to adopt the
planning scheme subject to a number of conditions as discussed below. A number of these
conditions required changes before scheme adoption and some warranted very detailed
consideration.
Condition 1 - State Planning Policy (SPP) 2017 – State interest: Natural hazards, risk and
resilience (Erosion prone areas)
Prior to adopting the proposed planning scheme Council must:
A. Include the following note in section 2.1.1, section 8.2.4.1 and on each map of the Coastal
Protection and Scenic Amenity Overlay map:
Editor’s Note – Development in the erosion prone area, as shown on the SPP interactive
mapping system, will be subject to assessment against the assessment benchmarks –
natural hazards, risk and resilience within the SPP.
B. Omit from part 2.1 the references to “policy 2, policy 3 and policy 6 after coastal hazards,
and insert “in part”; and
C. Omit from part 2.1.1 the references to “policy 1, policy 4, policy 5 and policy 6” after coastal
hazards and insert “in part”.
On or before 24 December 2020 Council must complete the coastal hazards adaption plan and
Page 4 of 40
Section 5
SPECIAL MEETING REPORT 16 JULY 2020
identify any necessary amendments to the planning scheme to fully integrate the SPP state interest
for natural hazards, risk and resilience (Erosion prone areas).
Changes required to the scheme have been made to meet condition 1A, B and C. The further
aspect to this condition including amending the scheme will occur as part of Council finalising the
Coastal Hazards Adaptation Plan (CHAP) later this year.
Condition 2 - State Planning Policy – State interest: Natural hazards, risk and resilience
(Bushfire prone areas)
Prior to adopting the planning scheme, Council must amend the Bushfire Hazard overlay map to
reflect the bushfire prone area identified on the State Planning Policy Interactive Mapping System.
The maps presented in the final scheme attached to this report (Attachment 12 Schedule 2.4 -
Bushfire Hazard Maps 1-14) have been amended to meet the requirements of this condition. There
are small areas of increase in the extent of bushfire hazard as a result however on balance the
change shows a decrease in extent of area subject to bushfire hazard. It is intended to advise land
owners affected by the changes as a result of this condition via letter following commencement of
the scheme.
Ongoing refinement to the bushfire hazard maps will continue to occur during the life of the planning
scheme and be subject to future amendments.
Condition 3 - State Planning Policy – State interest: Biodiversity (Matters of state
environmental significance)
Prior to adopting the planning scheme, Council must amend the Biodiversity, Waterways and
Wetlands overlay maps to reflect the MSES identified on the State Planning Policy Interactive
Mapping System.
The Matters of State Environmental Significance (MSES) relevant to Noosa Shire comprise the
following:
• MSES - Protected area – estates
• MSES - Protected area - nature refuges
• MSES - Fish habitat area
• MSES - Wildlife habitat - threatened and special least concern animal
• MSES - Regulated vegetation - category B endangered or of concern
• MSES - Regulated vegetation - category C endangered or of concern
• MSES - Regulated vegetation - category R GBR riverine
• MSES - Regulated vegetation essential habitat
• MSES - Regulated vegetation - 100m from wetland
• MSES - Regulated vegetation - intersecting a watercourse
• MSES - High ecological significance - wetlands
• MSES - High ecological value waters - wetlands
• MSES - High ecological value waters – watercourse
• MSES - Legally secured offset area - vegetation offsets
These values have been incorporated into the MSES layers presented in Schedule 2.4 –
Biodiversity (i) Maps and Biodiversity Riparian (ii) Maps attached to this report (Refer Attachments
10 and 11). The required changes have resulted in additional areas being mapped mostly as a
result of the MSES ‘essential habitat’ and ‘threatened and special least concern animal’ layers
being added. The changes only affect the layers referred to as MSES on the mapping and do not
affect council’s locally derived biodiversity and riparian layers. MSES is shown on this mapping for
information purposes only and relate to separate regulations set by the State. MSES have no
assessment role under the planning scheme.
It is intended to advise land owners affected by the changes as a result of this condition via letter.
Council staff are also working with the State Government to improve the MSES mapping which
may inform future scheme amendments.

Condition 4 - Planning Act 2016 (Section 43(5)(b)) and Planning Regulation 2017 (Schedule
6, Part 2, Section 2(2))
Prior to adopting the planning scheme Council must amend the scheme to make changes in
relation to dwelling houses in residential zones to ensure consistency with the Planning Act and
the Planning Regulation.
Accordingly the final version of the scheme presented for Council adoption (in Attachments 2 to 5
of this report) includes changes to the following parts:
Part 1.6 Building work regulated under the planning scheme (specifically Table 1.6.1 Building
assessment provisions)
Part 5.5 Categories of development and assessment for material change of use (specifically
Table 5.5.2 Medium Density Residential Zone, Table 5.5.3 High Density Residential Zone
and Table 5.5.4 Tourist Accommodation Zone)
Part 6.3.2 Medium Density Residential Zone Code
Part 6.3.3 High Density Residential Zone Code
Part 6.3.4 Tourist Accommodation Zone Code
Condition 5 - SPP – Guiding principles – Social Housing
Prior to adopting the planning scheme Council must amend the proposed planning scheme (refer
Attachment 1 for specific changes): Changes to the social housing performance outcomes (POs)
to ensure consistency with the guiding principles.
Changes have been made to relevant codes to reflect the requirements of this condition. Refer
Attachment 1.
Condition 6 - SPP – State interest: Biodiversity (Policy 5 – Koala conservation) and Planning
Regulation 2017 (Schedule 10, Part 10 and Schedule 11)
Prior to adopting the proposed planning scheme Council must reflect the new koala conservation
planning controls in the Planning Regulation 2017, which commenced on 7 February 2020 by:
A. amending the map, Koala Habitat Areas, in Schedule 2, to reflect the new koala habitat
mapping for South East Queensland (koala priority area and koala habitat area – core koala
habitat area and locally refined koala habitat area);
B. removing all provisions that relate to interfering with koala habitat (e.g. AO11.1 and AO11.3);
C. including a note/s that clarifies how the remaining provisions will be applied, in view of the
new koala conservation planning controls in the Planning Regulation 2017; and
D. updating terminology and references to reflect the new koala conservation framework (e.g.
updated Koala-sensitive design guideline: a guide to koala-sensitive design measures for
planning and development activities).
Changes to the Koala Conservation requirements and Planning Regulations came into effect
Friday 7 February. The Minister has required Council’s planning scheme reflect these changes.
Accordingly all changes have been made to the final scheme to reflect this condition. Changes can
be found in Attachment 1.
Council will continue to work with Department of Environment staff to improve and refine Koala
mapping based on detailed local Koala mapping work, any changes to mapping will be subject to
future amendment processes.
Condition 7 - SPP – Guiding Principles – Noosa Business Centre – Levels of assessment
Within 12 months from the date of adoption of the proposed planning scheme Council must
commence a process to review the provisions of the Noosa Business Centre to provide more
detailed planning guidance and outcomes sought for the Noosa Business Centre reflective of its
role as a Major Centre for Noosa. This process should include a review of the levels of assessment
and regulation that will inform an amendment to the planning scheme to integrate the outcomes of
this process.
Section 7
SPECIAL MEETING REPORT 16 JULY 2020
This condition does not require any amendments to the Planning Scheme prior to its
commencement. It requires Council to commence a review of the provisions that relate to the
Noosa Business Centre. The review is to provide more detailed guidance to the future planning of
the centre as well as to review levels of assessment for land uses. This will be required to be
commenced within 12 months of adoption of the scheme to inform a future amendment.
Condition 8 – SPP – State interest: Planning for liveable communities and housing (Housing
supply and diversity) and Planning for economic growth (Tourism)
A) Within three months from the date of adoption of the proposed planning scheme Council
must prepare and publish a comprehensive guide explaining the regulatory requirements for
operating short-term accommodation in the Noosa Shire Council local government area.
B) On commencement of the planning scheme and for a period of 2 years Council is to monitor
the provisions relating to short-term accommodation, tourism and housing supply considering
the outcomes sought across the residential zones. The process shall, at a minimum:
include a detailed analysis of the existing situation within the Noosa Shire, including
numbers and types of short-term accommodation uses. This analysis should include
annual comparison data that demonstrates the performance of the relevant scheme
provisions;
consider the economic and social benefits of the current situation, and forecast the
potential long-term impacts of short term accommodation across the residential zones;
consider the zone intent, levels of assessment and regulation short-term
accommodation across the residential zones.
consider the state interests of Housing supply and diversity and Tourism;
be evidence-driven, comprehensive, and prepared in a detailed manner.
C) Within 6 months of completing B) above Council must submit a report to the Minister on
completion of the monitoring process. The report must detail the findings of the monitoring
process and provide an accompanying statement from the council that identifies whether the
council considers an amendment should be made to the planning scheme as a result of the
monitoring process, and the reasons for the council’s position on this.
This condition does not require any amendments to the planning scheme prior to its
commencement but will require Council to monitor the provisions in accordance with paragraph B
for the next two years and provide a report to the Minister on the outcomes of that monitoring
process. To meet paragraph A requirement, a factsheet with guidance material will be prepared
and published for the commencement of Noosa Plan 2020.
To meet (B) of the above baseline data is being established and will continue to be monitored over
the next two years.
3. Next Steps
In accordance with the Ministers Guidelines and Rules for making a planning scheme and the
Notice made under section 18(3) of the Planning Act 2016, this report seeks Council endorsement
of the final Noosa Plan 2020. Should Council adopt the scheme, notification of this will be given
through the government gazette and local media.

Finance
The preparation of Noosa Council’s new Planning Scheme has followed a statutory procedure and
tailored instructions from the State Government in accordance with the Planning Act 2016. The
preparation of the Planning Scheme, which began in 2016, has involved a dedicated project team,
technical consultants and legal and peer review processes. A significant financial and resource
investment has been made in this process, close to $3.2 million.
A number of the Ministerial conditions require Council to undertake further and future work, there
will be some financial and resource impacts of these conditions which will be considered during
2020/2021 budget process.
Risks & Opportunities
The current Planning Scheme, while amended numerous times, dates back to 2006 and was
written in accordance with the Integrated Planning Act. No further amendments to the current 2006
scheme are likely to be approved by the State. It is imperative that a new Planning Scheme, which
is not only compliant with the Planning Act 2016, reflective of revised State Planning Policies and
responds to emerging trends and challenges, be adopted soon.
Importantly, there is no provision to further modify the draft scheme prior to gazettal. If Council
decides not to adopt the scheme as approved by the Minister the plan preparation process must
start again. If this was to occur various planning studies on which the draft was based are likely to
need to be redone as their currency will diminish with time.
Consultation
External Consultation - Community & Stakeholder
The draft planning scheme has been the subject of extensive community consultation undertaken
during its preparation. In 2019 Council gave consideration to over 1,000 submissions received
during two formal consultation stages. The input of the Noosa Shire community has noticeably
shaped and refined the final scheme.

Additional section informing that an infrastructure charge, for the purpose of recovery, is taken to
be “rates” of the local government and the recovery actions that may apply.
Section 9.7 Interest on overdue charges
Additional section informing that compound interest applies on overdue infrastructure charges.
Section 9.8 Goods and services tax
Additional section informing that GST does not apply to infrastructure charges.
Section 10.3 Allocation of levied charge to trunk infrastructure networks
Amend Table 10.2:
For Non-Residential development, amend allocations from Transport (85%) and Public parks
(15%) to Transport (100%) and Public parks (0%).
This is to align with the new planning scheme LGIP for the Public parks and land for
community facilities network’s Desired Standard of Service (DSS) where the “Land provision
target” and “Demand” only relates to population i.e. based on residential development only.
Remove Note # regarding applicability of the Stormwater component of the charge to
development only within the PIA as this is only required in the following Section 10.4.
Section 10.4 Schedule of Council Adopted Infrastructure Charges (under breakup agreement)
Amend Table 10.3 Schedule of Council adopted charges to:
reflect a similar layout to Schedule 16 of the Planning Regulation 2017 with charge rates
applicable to:
o The Noosa Plan 2006 (superseded planning scheme) development uses; and
o The Noosa Plan 2020 (new planning scheme) coinciding with Schedule 16 of the
Planning Regulation 2017 development uses;
provide additional transparency to include the basis, amounts and resulting percentage of
Council adopted charge reductions for those specified development uses. The charge rates
have been maintained to those previously adopted under Resolution No.4 for the current
2019-2020 financial year with the exception of Indoor sport and recreation “court area” where
the $1.29/m2 former “parks network” component reduction no longer applies.
Amend Note (3) to Network Reductions:
a) The Stormwater component of the charge is excluded for development located
outside the Coastal Area, Cooroy and Pomona PIA service catchments.
This is due to the new planning scheme LGIP that has changed the level of Stormwater
“trunk” infrastructure (i.e. increased the minimum “trunk” pipe diameter from 450mm to
650mm) with no trunk stormwater existing or currently planned for the Boreen Point,
Page 14 of 40
Section 15
SPECIAL MEETING AGENDA 16 JULY 2020
Cooroibah, Cooran, and Kin Kin PIA service catchments. This is anticipated to have minimal
impact on the overall level of future infrastructure charges revenue.
b) The Transport component of the charge is reduced by:
o 12% for development located outside the PIA service catchments;
o 2% for development located inside the Boreen Point, Cooroibah and Kin Kin PIA
service catchments.
This is due to the new planning scheme LGIP Transport network not generally providing
additional pathway and public transport trunk infrastructure outside the PIA areas and no
further public transport trunk infrastructure (bus stops) in Boreen Point, Cooroibah and Kin
Kin PIA areas. The reduction % amounts have simply been based on the proportions of the
network existing plus future works values taken directly from the SOW model as follows:
EXISTING FUTURE
TRANSPORT Network TOTAL VALUE %
Refined Asset Value Adjusted Current Day Value
Roads $240,849,450 $15,543,104 $256,392,554 87%
Pathways $18,733,221 $11,781,008 $30,514,229 10%
Bus Stops $3,711,308 $3,356,926 $7,068,234 2%
TOTAL = $263,293,979 $30,681,038 $293,975,017 100%
add Note (4) regarding Reconfiguration of a lot charges for Non-residential development to
align with section 10.3 notation.
Section 11.4 Recalculation of establishment cost for an infrastructure offset
Update item (1) & (2) references from the former “s. 657 of SPA” to the current “s. 137 of the
Planning Act”.
Section 12.3 Payment of a refund
Clarify in (1) (b) (i), (ii) & (iii) that the refund is made after “off-maintenance” handover of the trunk
infrastructure to Council.
Previous Council Consideration
Ordinary Meeting Minutes, 28 August 2014, Item 2, Page 6
That Council note the report by the Priority Infrastructure Planning and Infrastructure Charges
Officer to the Planning & Organisation Committee dated 28 January 2014 and:
1. Adopt the “Noosa Shire Council Adopted Infrastructure Charges Resolution (No.1) 2014”
(provided at Attachment 1 to the report) to replace the “Sunshine Coast Regional Council
Adopted Infrastructure Charges Resolution (No.4) 2011” applying to development governed
by The Noosa Plan;
2. Publicly notify the adoption of the “Noosa Shire Council Adopted Infrastructure Charges
Resolution (No.1) 2014” and forward a copy to the Chief Executive, Department of State
Development, Infrastructure and Planning in accordance with section 648D of the
“Sustainable Planning Act 2009”;
3. Adopt Noosa Council policy positions regarding Extensions to Relevant Periods (through
infrastructure agreements) and/or subsequent Infrastructure Charge Notices triggered by
Building Permits, to charge development for all networks, including those previously missing
where:
a) missing networks are to be charged at the current Adopted Infrastructure Charges; and
b) the missing network charge is limited so that it does not cause the total amount
payable for the development to exceed the total maximum adopted charge
permissible under the “Statutory Planning Regulatory Provision (adopted charges)”.

SPECIAL MEETING AGENDA 16 JULY 2020
4. For development requesting to transfer to an alternative infrastructure charges regime to
that previously applied under an existing development approval, Council:
a) require a new development application to be lodged; and
b) offer a 50% reduction to the application fee for these new development applications,
provided there is no change to the development previously approved and no additional
assessment is required to that previously undertaken under The Noosa Plan; and
c) request the applicant to cancel their previous development approval under sections
379 and 380 of the “Sustainable Planning Act 2009” at no cost to the applicant, once a
dew development approval takes effect.
5. Note the State Government’s review of the current Adopted Infrastructure Charges regime
is likely to impact the level of infrastructure charges that can be levied on future development
and priority infrastructure planning requirements. A further report will be provided to Council
once the outcome is known.

“Amended Infrastructure Charges Notices” removing the stormwater component of the
charge;
2. Apply the annual indexation methodology in line with item 9.5 (3) “Automatic
increase provision of levied charge” contained in the new “Noosa Shire Council
Charges Resolution (No.3) 2018” for all infrastructure charges remaining to be paid
that were issued from 1 July 2011 under all previous adopted “Council Charges

Charges Resolution (No.4) 2019” provided at Attachment 1 to the report (with a correction to
section 13.6(i)(c) to refer to clause 145 of the Planning Act), to take effect on Monday 23
September 2019 replacing the “Noosa Shire Council Charges Resolution (No.3) 2018”.
Finance
Council is required to have an adopted a Charges Resolution that is compliant with current planning
legislation to issue infrastructure charges and impose conditions about trunk infrastructure on
development. The infrastructure charges revenue is estimated in the order of $2 million per annum.
Risks & Opportunities
Regular reviews with appropriate updates to Council’s Charges Resolution will reduce the risk for
potential legal appeals being lodged against infrastructure charges issued on development.

EXECUTIVE SUMMARY
Not applicable.
RECOMMENDATION
That Council note the report by the Manager Development Assessment to the Special Meeting
dated 16 July 2020 regarding the Fees and Charges 2020-21 for the new Planning Scheme –
Noosa Plan 2020.
A. Agree to adopt the proposed fees and charges for Material Change of Use applications
lodged under the new Planning Scheme as set out in Attachment 2 to this report;
B. Continue to apply the current fees and charges 2020-21 for all other matters lodged under
the new Planning Scheme; and
C. Note that Superseded Planning Scheme requests are currently delegated to officers to
decide due to the legislative time frames.
REPORT
Fees and Charges for new Planning Scheme – Noosa Plan 2020
Under the Planning Act 2016 a development application must be –
(a) made in the approved form to the assessment manager; and
(b) accompanied by –
(i) The documents required under the form to be attached to, or given with, the application;
and
(ii) The required fee.
While Council sets its fees and charges for planning and development matters each financial year,
the new Planning Scheme for Noosa Shire will commence shortly. It is therefore necessary for
Council by resolution to set fees and charges for the new Planning Scheme for 2020-21.
Attachment 1 includes a copy of the current fees and charges for 2020-21 for Council’s reference
and Attachment 2 includes the proposed fees for 2020-21 for the new Planning Scheme.
The proposed fees and charges for the new Planning Scheme have been aligned where practical
with the current fees and charges to achieve consistency between the fees and charges for each
scheme. This means for example that an application for a shop under the current Noosa Plan and
an application for a Shop under the new Noosa Plan 2020 will be the same. For new land uses
identified under the new Noosa Plan 2020, such as short term accommodation a new fee is
proposed.
Section 19
SPECIAL MEETING AGENDA 16 JULY 2020
The proposed new fees list only the fees that will be applicable for Material Change of Use
applications, with the current fees and charges for Reconfiguring a Lot, Operational Works, Minor
Change and Extensions to Relevant Period etc. continuing to apply to applications under the new
Planning Scheme. New fees for Material Change of Use applications have been set to match the
new use definitions under the new Planning Scheme.
Superseded Planning Scheme
Both sets of fees and charges (for the current Planning Scheme and the new Planning Scheme)
will need to be in place for 1 year from the commencement of the new Planning Scheme, given the
ability to make a Superseded Planning Scheme request. After 1 year the fees for the current
Planning Scheme will no longer be required and only the new Planning Scheme fees will apply.
A Superseded Planning Scheme is a Planning Scheme, together with related Planning Scheme
policies, that was in effect immediately before the new Planning Scheme commences. A person
may within 1 year after the Planning Scheme and related policies become a Superseded Planning
Scheme, make a Superseded Planning Scheme request.
A Superseded planning request is a written request to Council to accept, assess and decide a
development under the Superseded Planning Scheme; or apply a Superseded Scheme to a
development that was accepted development (and no approval required).
The current fees and charges include a fee of $1,380 for a superseded scheme request plus the
required fee where a development approval is required under the Superseded Planning Scheme.
Notably if the development was accepted development under the Superseded Planning Scheme,
then only $1,380 would apply.
Under the Planning Regulation 2017, Council must decide whether or not to agree to a Superseded
Planning Scheme request within 30 business days after the request is received, which may be
extended where the applicant agrees in writing before the period ends. If no decision is made by
Council, the Council is taken to have agreed to the Superseded Planning Scheme request.
Notably, Superseded Planning Scheme requests are currently delegated to officers to decide given
the stringent time frames set by the Planning Regulation 2017. Notwithstanding this, where officers
propose to not agree to a request under the Superseded Planning Scheme, where time permits,
officers intend to report the matter to Council.
Assessment of superseded planning requests will have regard to such matters as the potential
impacts from the proposed development (such as environmental, amenity, traffic impacts, etc. and
broader impacts on achieving the vision of the new Planning Scheme) and consistency with other
developments in the surrounding area.
Conclusion
It is therefore recommended that Council adopt the proposed fees and charges in respect to the
new planning scheme.
Previous Council Consideration
Nil.
Finance
The proposed fees and charges for the new Planning Scheme generally align with the fees and
charges applicable to the current Planning Scheme and therefore it is expected that these fees
and charges will have minimal impact on the budget. In developing the budgeted revenue for
2020/21 consideration was given to the new Planning Scheme’s lowering of assessment levels
from impact to code assessment for some developments and the 25% difference in fees between
code and impact assessment applications.
Risks & Opportunities
As the new Planning Scheme incorporates some new uses under the Planning Act 2016, it is
necessary for Council to adopt new and updated fees for the new Planning Scheme upon
commencement of the scheme.
