Dear Sir/Madam
RE: PERMISSABLE CHANGE TO A DEVELOPMENT APPROVAL
APPLICATION TO CHANGE DEVELOPMENT APPROVAL 12506 AND 132009.1102.1 FOR
-
EXTENSION TO AN ENTERTAINMENT & DINING BUSINESS TYPE 1 (FOOD & BEVERAGE)
FOR LOTS 6 & 7 AND EXTENSION TO RETAIL BUSINESS TYPE 2 (SHOP& SALON) FOR LOT
1 OVER LAND AT TENANCIES 1,6 & 7 AND COMMON PROPERTY AT HASTINGS STREET
NOOSA HEADS DESCRIBED AS LOTS 0, 6 and 7 ON SP120366
I refer to the above application note the application to change the above development approvals is
currently being assessed by Council and Council staff have advised that carparking is likely to be a
significant issue. In this regard the applicant commissioned MRCagney to prepare traffic advice in
relation to the provision of carparking provision on site. The report concluded that appropriate
carparking is provided on the site for the proposed uses.
Staff have since reviewed the report and advise that whilst the contents of the report are supported
and that appropriate carparking is provided, they will still recommend that a contribution in lieu of the
provision of carparking be paid. In this regard a contribution of $18000.00 per space is indicated as
being applicable to the development.
The applicant indicates that payment of the contribution is not reasonable nor relevant to the
proposal for the following reasons:
. The exclusive use area associated with the Chemist does not increase staff or numbers
patrons visiting the site as it is a small retail area,. This area is currently utilised and has no
significant impact in terms of carparking.
. The new outdoor dining area proposed with the restaurant to the centre of the site was
previously used by Sandy’s Deli without impact on overall carparking numbers in the area.
. Most patrons to the site are carrying out multiple visits to the Hastings Street precinct and
therefore it is not reasonable to impose the full cost of contributions on the development.
. The premises the subject of this application, contains two restaurants which will employ a
number of casual hospitality staff. It is noted that the majority of hospitality staff in the
Hastings Street precinct are generally young or travelers who utilise public transport,
carpool or scooters due to the high cost of running cars. Therefore staffing associated with
premises will not attract additional carparking demands for the site. It is also noted that the
site currently has 9 designated ’shop’ spaces on the site for the entire complex. During

.:
spaces were empty at any given time. Therefore the existing designated shop parking is
underutilized and spare capacity is available on the site.
. A review of carparking on site and the surrounding area was undertaken (Attachment A)
and again demonstrated that surplus carparking was available in the area during non peak
times. It was noted that the car park was full during events such as the ’Noosa Festival of
Surfing’ and the ’Noosa Food & Wine Festival’, however it is not feasible or current practice
for any carparking area to cater for peak events.
. The site has had issues with staff and patrons of other sites parking on the premises for all
day parking. As a result, the Body Corporate has implemented a number of measures
aimed at discouraging non site patrons from parking on the site. These measures include
the gates not opening until 9.30 am and the employment of a carparking attendant.
Observations and discussions with the on site carparking attendant indicate that there is a
high turnover of parking when the attendant is on site and that on most occasions
carparking spaces are available. The carparking area also has a two hour limit that further
increases turnover of carparking spaces.
. The Sunshine Coast Sustainable Transport Strategy indicates as one of its goals is a shift to
public and active transport. The Strategy indicates that many developments carparking are
currently underutilized and that minimum carparking requirements should be reduced. The
proposal is consistent with the findings of this Strategy and therefore the current carparking
rate detailed under the planning scheme is inappropriate for the development.
. The site fulfills criteria relating to Councils Sustainable Transport Strategy as it is well
located to pedestrian footpaths, cycling facilities, public transport (Noosa Drive terminal) and
carparking areas.
. The existing and future uses on the site include two restaurants which will predominately
provide a service to people in staying in the Hastings Street area. These people do not
require additional carparking spaces in the Hastings Street area.
. The imposition of a carparking contribution for the development would not be a reasonable
condition as the overall cost of the contribution of $252,000.00 is prohibitive for the overall
scale and use as proposed and the available carparking on site and within the surrounding
area.
The Assessment Manager’s favourable consideration of the imposition of no carparking contributions is
sought. Please contact our Sunshine Coast office if you require any further information and/or clarification
with respect to the above application.
Yours sincerely
