on water quality, due to proposed changes to natural drainage and insufficient stormwater
management devices. The proposal therefore does not comply with PO26.
ENVIRONMENTAL MANAGEMENT AND CONSERVATION ZONE
Portions of the development are located within the mapped Environmental Management and
Conservation (EM&C) zone (refer to Figure 20), noting that this zoning correlates with the mapped
riparian buffer area under the Biodiversity, Waterways and Wetlands Overlay mapping. Short-term
accommodation is an inconsistent use with the EM&C zone, with the purpose of the zone being to
provide for the protection and maintenance of areas that support biological diversity, ecological
integrity, naturally occurring landforms and/or coastal processes.
Figure 20 – Zoning
The overall outcomes sought for the Environmental Management and Conservation Zone and
relevant to the proposal are as follows:-
(a) Land identified as ecologically important areas, water catchments, beach protection or
coastal management areas or natural areas with historical or cultural values are
protected from development;
(b) Development avoids and mitigates against adverse impacts on the values and
processes within ecologically important areas;
The subject site is identified as an ecologically important area and coastal management district
(under the State’s Coastal Protection mapping), and as such the proposal to develop the land is
contrary to Overall Outcome (a). Additionally, although it is acknowledged that the design of the
development aims to mitigate against adverse impacts, as discussed above, the proposal does not
avoid impacts on the values and processes within an ecologically important area.
The applicant has provided the following comments in regard to development within the EM&C
zone:
• While the development encroaches into the EMCZ, this is because the vegetation on the
site has been surveyed and identified and carefully considered by the koala expert, ecology
and bushfire experts and also the expert arborist. The proposed eco-cabins have been
specifically designed and located within the areas shown on the tree retention and removal
plan to maximise tree retention and koala habitat.
