Figure 8 - Proposal Plan for 132006.1395.05
The minor change was refused on various planning grounds under Noosa
Plan 2006, including:
• The proposal was contrary to the Planning Regulation 2017, as the
development was situated in a koala assessable development area and
did not provide for habitat connectivity or safe koala movement.
• The proposal was inconsistent with biodiversity assessment benchmarks
of the State Planning Policy, as the development would have adverse
impact upon koala habitat and linkages.
• The proposal was inconsistent with water quality assessment
benchmarks of the State Planning Policy, as the development did not
adequately demonstrate that water quality objectives could be achieved.
• The proposed development would adversely impact upon the site’s
ecological values, including koala habitat and linkage for koala movement
throughout the site, contrary to the Biodiversity Overlay Code.
• The proposed development was inconsistent with the Noosa Heads
Locality Code as the proposal would adversely impact on the site’s
environmental values.
• The proposed Bushfire Management Plan proposed vegetation removal
and management within a part of the site which was zoned Open Space
Conservation, which was intended to be protected and managed to the
exclusion of development under Noosa Plan 2006.
• The development was contrary to the Natural Hazards Overlay Code, as
bushfire mitigation measures did not avoid or minimise impacts on the
natural environment and ecological processes.
• The proposed development was contrary to the Water Sensitive Design
Code, as modelling for stormwater treatment did not included all relevant
run-off areas.
• Insufficient detail was not provided to demonstrate the extent and
potential impact of the proposed height variation for the dwelling units.
• The proposed development was contrary to the draft Noosa Plan
provisions (ie the current Noosa Plan 2020 provisions), which reinforced
the Noosa Plan 2006 requirements for an appropriate response to the
site’s natural hazards and protection of the site’s environmental values,
including vegetation retention.
