5.2.3      Planning Scheme Codes

The following planning scheme codes are applicable to the proposed development:
     Eastern Beaches Locality Code
     Reconfiguring a Lot Code
     Landscaping Code
     Engineering Works Codes
     Biodiversity Overlay Code
     Natural Hazards Overlay Code
     Natural Resources Overlay Code

An assessment against the relevant Specific Outcomes and Probable Solutions of the Eastern Beaches Locality
Code and the Reconfiguring a Lot Code is provided at Appendix A. The Overall Outcomes of the applicable codes
are addressed below:

RECONFIGURING A LOT CODE

The proposal meets the relevant Overall Outcomes of the Reconfiguring a Lot Code in that:
     the proposed lot sizes and dimensions are appropriate for their intended use;
     the proposed lots have safe and appropriate access via a shared access easement to David Low Way;
     the proposal does not impact on environmentally sensitive areas;
     the proposal does not create any increased risk of natural hazards ie. bushfire or landslide given the
       existing density is being maintained at only two dwellings;
     the proposed lots are able to be adequately serviced with infrastructure, including electricity and
       telecommunications, reticulated water and on-site sewer; and
     the proposed lots and building envelopes will facilitate an energy efficient building design for future
       dwellings.

LANDSCAPING CODE

The proposal meets the relevant Overall Outcomes of the Landscaping Code in that:
     the proposal retains the natural landscape character of the site and locality;
     the proposal retains existing vegetation and other natural features of the site, other than minor clearing
        for upgrading of site access;
     the proposal ensures the protection of any native wildlife habitat, ecological and biodiversity values of
        the site;
     the proposal facilitates efficient stormwater management;
     the proposal ensures privacy between dwellings through adequate separation of buildings and retention
        of existing vegetation;
     the proposal does not seek to remove vegetation that is required to ensure land stability.
