MCU260003 - Response to Information Request
Response:
Revised plans prepared by Georgia Starkey, dated 04/06/2026 (reference VG127 – revision 5), have been
prepared (refer Attachment 1). The plans relocate the driveway to a central position within the subject site,
with a crossover width of 4.0 metres. The design of the driveway crossover is supported by Engineering Plans
prepared by Stanford Consulting, dated 21/06/2026 (ref2327 C01 – revision A) an RPEQ (refer Attachment
2).
In relation to the request to provide an assessment against the Driveways and Parking Code, a full assessment
against the code is not considered necessary for a dwelling house, with a secondary dwelling. Despite this,
some supporting information is provided by Stanford Consulting addressing the key issues under the
Driveways and Parking Code (refer Attachment 3).
The code includes provisions for off-street parking associated with dwelling houses with a secondary dwelling.
The revised plans demonstrate compliance with Acceptable Outcome AO6.1 by providing a total of three (3)
on-site parking spaces, comprising two (2) covered and one (1) uncovered.
Item – Earthworks
There is a considerable amount of earthworks proposed on site. The proposal plans indicate that a series of cuts,
fills and associated retaining walls will be required to facilitate the development of the site.
The extent of the earthworks required to carry out the development, and their impact on adjoining properties, is
unclear.
An assessment against the Earthworks Code has not been provided.
Information Required
3. Provide an Earthworks Plan detailing the extent of earthworks and associated retaining structures. The
Earthworks Plan must be prepared by a suitably qualified person (RPEQ) and include, but not be limited
to:
a. The extent of earthworks (extent of cut/fill, levels, batter grades, etc); and
b. Details of any associated retaining structures (heights, levels, cross-sections, etc).
4. Provide an assessment against the Earthworks Code.
Response:
The Planning Act 2016 defines building work to include excavation or filling undertaken to facilitate the
construction of a new building or the extension of an existing building. In this regard, the earthworks
proposed to facilitate the construction of the secondary dwelling and the extension to the existing building
constitute building work rather than operational work.
The revised plans demonstrate that the extent of any cut and fill on the site will be less than 1.5m from natural
ground level (NGL) (refer Attachment 1). Consequently, the applicable provisions of the Earthworks Code
include Acceptable Outcome 9 (AO9), which permits cut and fill up to 1.5 metres. The proposed development
will not exceed this threshold and the earthworks necessarily required are centrally located in the site. As
such, the extent of cut and fill remains within the acceptable outcome and maintains compliance with the
Earthworks Code and will not cause any adverse amenity impacts.
