Of these, the statutory planning instruments relevant to this application are discussed in the
sections that follow.
3.2. State and Other Statutory Instruments
South East Queensland (SEQ) Regional Plan 2009 - 2031
The site is located within the Regional Landscape and Rural Production area of the SEQ
Regional Plan and the proposal is consistent with the regional policies and Regulatory
Provisions of the SEQ Regional Plan.
3.3. Statutory Instruments – Planning Scheme
The subject site is located in the Boreen Point, Kin Kin, and Cootharaba Locality and is
zoned Detached Housing. The proposed use is identified as a consistent use within the zone
and is required to undergo a code assessment application process, with Council acting as a
Concurrence Agency.
Land Use & Works Provisions
The Detached Housing Code regulates land use and design for this application. The
application has been assessed against the Code and the pertinent issues arising out of the
assessment are discussed below:
Setbacks
The dwelling is sited in accordance with the Building Approval providing a setback of
between 3.3m and 6m to Main Street. The Building Approval was unlawfully issued because
this setback distance does not comply with the Acceptable Solution, which requires a 6m
setback to street frontages. The encroaching part of the building is triangular in shape and is
shown in Figure 3 below.

Figure 3 – The red line shows the 6m setback and the purple outline shows the extent of the
encroachment.
