Attached to the e-mail Dwelling House in Coastal Protection - MCU24/0155.
In accordance with Part 5 of the Noosa Plan 2020, the development is assessable against the following
codes:
• Low Density Residential Zone Code
• Low Density Housing Code
• Coastal Protection and Scenic Amenity Overlay Code
In accordance with the Planning Regulation, the development is also subject to Council’s concurrence
agency assessment of the non-compliances with the QDC Provisions identified in Table 1 above.
4.1 Low Density Residential Zone Code
The proposed dwelling house complies with most of the Acceptable Outcomes that are an alternative
Provision to the QDC in the Dwelling House Code. As reflected in Table 1 above, the proposed dwelling
does not comply with the required front setback. Justification against Performance Outcome PO9 has
been provided below.
4.1.1 Acceptable Outcome AO9.1 – Front Setbacks
The Low Density Residential Zone Code includes setback requirements alternative to the Queensland
Development Code (QDC). Acceptable Outcome AO9.1 requires the proposed dwelling house to be
setback 6.0m from the front boundary. The design includes a proposed feature planter which is setback
4.5m from the front boundary. As such, justification against Performance Outcome PO9 has been
provided below.
• The proposed dwelling provides a high level of amenity to users and adjoining residents. The site
and rear boundary setbacks are compliant and the new dwelling will not cause any negative
impacts on the adjoining residents.
• The proposed dwelling follows the natural slope of the land. This enables a stepped design of the
house without obstructing any views or overlooking private open space or habitable areas of
adjoining premises.
• The proposed dwelling will provide more than the required amount of landscaping with the
development proposing 49% of the site to be landscaped.
• The house has been designed to blend with the coastal streetscape. The colors, variations, and
landscaping play a significant role in this design.
• The subject site does not contain any ecologically important areas. However, there is a reserve
located at the rear of the property. The proposed dwelling is setback 6 metres from the rear
property line, ensuring that the integrity of the reserve remains intact.
Overall, the proposed feature planter provides a positive design outcome for the site and will have not
adverse impacts on neighbouring properties or the streetscape.
4.2 Low Density Housing Code
The proposed dwelling house complies with most of the Acceptable Outcomes that are alternative
provisions to the QDC. As reflected in Table 1 above, the proposed dwelling does not comply with AO8.1
(Driveway and crossover) and AO22.1 (Landslide Hazard Area). Justification against the corresponding
Performance Outcome PO8 and PO22 has been provided below.
4.2.1 Acceptable Outcome AO8.1 – Access Design
Acceptable Outcome AO8.1 of the Low Density Housing Code requires that driveways and crossovers be
designed according to the Council’s Standard Drawings. The proposed driveway design has a minor non-
compliance with RS-049, as the widths at the kerb and in the middle of the crossover exceed the preferred
maximum allowed by approximately 400 to 700 millimetres. However, since this is a minor exceedance,
