Extension Application Letter_Final

The site has been subject to a number of subsequent development applications, which Council
has refused and have been appealed to the Planning and Environment Court. The applicant has
spent their time running the application and appeals process to ground for these applications.
Because of this, the above approval has not been enacted whilst these subsequent applications
were assessed and going through the appeal process. A decision on the applicant appeal was
handed down by the Planning & Environment Court on 13 December 2019. Since that time, the
applicant has briefed Development Directive (Project Management) to assist in enacting the
approval, however, we are concerned that the applicant will not be able to complete the project
within the currency period, due to lapse on 6 December 2020.

Today, the current planning scheme in place is still the Noosa Plan (8 June 2018). We confirm
that the same zoning and overlays apply to the proposal as they did when the proposal was
assessed. The proposal is consistent with the current planning scheme.

An additional mapping layer, for Koala Habitat Areas, is currently applicable over the site that
wasn’t part of the original application. The extent of applicability over the site is contained within
a small slither along the W boundary of the site. See Figure 1 below. As a condition of the
approval, it requires the registration of a vegetation covenant which will protect areas of
vegetation that includes vegetation mapped as Koala Habitat Areas. Accordingly, the approval is
consistent with this overlay (particularly, O7 of Part 13 – Biodiversity Overlay Code). The approval
is also for a Reconfiguring a Lot, and therefore also does not propose any structures as part of
this development. As such, it is considered that the approval is still able to comply with the
planning scheme and current requirements.

Figure 1 – Koala Habitat Areas

It is the Applicant’s intent to enact the proposal, as approved. We believe that an extension of 4
years is reasonable to ensure that the development can be enacted within the currency period.

On these grounds, we believe that the requested extension is reasonable and should be
approved.

Kind regards,
