Officer: Billy Glover Direct Telephone: 07 53296109 Our Reference: MCU19/0134 Your Reference: 19360 28 November 2019 BNB Super Pty Ltd C/- Project Urban PO Box 6380 MAROOCHYDORE QLD 4558 [email protected] Dear Sir/Madam Information Request Planning Act 2016 I refer to your application and advise that Council requires further information to satisfactorily assess the proposal. application details Application No. MCU19/0134 Street Address: 5 Taylor Ct Cooroy Qld 4563 Real Property Description: Lot 5 SP 197517 Planning Scheme: The Noosa Plan (8 June 2018) INFORMATION REQUIRED The information requested is set out below: Issue – Operating Hours The application does not specify the proposed operating hours of the proposed Entertainment and Dining Business Type 3 Bar use, and subsequently does not demonstrate compliance with Specific Outcome O1 of the Cooroy and Lake Macdonald Locality Code. O1 Uses are located, designed and operated to avoid significant adverse changes to the light, air quality, noise, accessibility or other conditions enjoyed by users of associated, adjoining or nearby uses. Information Required Provide the proposed operating hours of the proposed Bar use and supporting details demonstrating compliance with Specific Outcome O1 of the Cooroy & Lake Macdonald Locality Code. In this regard, particular consideration must be given to the other industrial tenancies of the approved industrial development of 5 Taylor Court (MCU18/0120). Issue - Carparking As per Probable Solution S7.1 of the Driveways and Carparking Code, on-site carparking for the proposed Bar use is to be provided at the following rate. Entertainment and Dining Business Type 3 Bar 1 space per 10m2, or part thereof, of use area. Minimum on-site carparking (59 spaces) was proposed and approved for the 39 Industrial Business Type 2 Production, alteration, repackaging & repairing use tenancies on the site (MCU18/0120). Based on the area of tenancies 1 and 11, these tenancies combined are afforded the use of 2.6 spaces only. Subsequently, it is apparent no residual on-site carparking is available for the proposed Bar use which requires carparking at the above rate, significantly greater than that required for Industrial uses. Information Required Provide details and material demonstrating compliance with Specific Outcome O7 of the Driveways and Carparking Code, prepared by a suitably qualified and experienced traffic engineer. Issue – Gross Floor Area The gross floor area of the subject tenancies (including mezzanine) as detailed within the proposal plans is not consistent with the original development approval over the site (MCU18/0120). Information Required Provide amended proposal plans detailing the gross floor area of the subject tenancies (including mezzanine) consistent with the original development approval over the site (MCU18/0120). Issue - Use Area The proposed use area of the proposed Bar use may need to be amended considering items 1, 2 and 3 above. Additionally, the suggested use area of the proposed Bar use does not align with the use area definition of The Noosa Plan. The toilets are for staff and patrons, not the general public. Therefore the area occupied by the toilets is included as use area for the proposed Bar use. Furthermore, no indication has been provided in the application, if the equipment (ferm, wash and mash and other equipment) will be installed in stages or all provided in the first instance. use area means the sum of the area of the premises (exclusive of all walls and columns), including all storeys, used or intended for use for a particular purpose. The term excludes— a) the areas (inclusive of all walls and columns) of any lift rooms, motor rooms, air conditioning or other mechanical or electrical plant or equipment rooms located at any topmost storey; b) The areas of any staircases or liftwells; c) The areas of any common foyer or arcade; d) The areas of any public toilets; and e) The areas used for the access, parking and associated manoeuvring of motor vehicles. Information Required Provide amended proposal plans detailing the proposed use area of the proposed Bar use in accordance with the use area definition of The Noosa Plan. It is recommended both male and female toilets be provided within tenancy 1 for suitable access and use by patrons of the proposed Bar use. The use area of the proposed Bar use may need to be amended considering items 1, 2 and 3 above. The use area of the proposed Bar use must not exceed 20% of tenancy 1 and 11 combined. Provide an indication of when all of, or part of the distillation and holding equipment will be installed (in stages or in the first instance). Advice Type 2 Industrial Use (Distillery) With regard to the industrial use, Council advises the applicant of condition 5 of the original development approval over the site (MCU18/0120), as follows: The approved use must not operate outside the hours of 6am to 7pm Monday to Saturday and not at all on Sundays or public holidays. The requirements of this condition must be included in the Community Management Statement for any body corporate for the subject site. due date for response to information request The due date for providing the requested information is 2 March 2020.
