1.1. . PROPERTY DETAILS: - Description: Lot 174 on RP884826 Zone: Low Density Residential Overlays: Land Subject to Acid Sulfate Soils - Area 2 — 5m AHD or Below Flood Hazard — Flooding & Inundation Extent South East Queensland Regional Plan: Urban Footprint 1.2 SITE DESCRIPTION The subject property is located on the south-eastern side of Key Court at the mid- point along the cul-de-sac at Noosa Heads. The land contains a total area of 1,268m2. The land is flat. The property was originally developed as 2 Lots (Lots 173 & 174 on N21858) in 1976 as a part of the development of Noosa Sound. The lands were later amalgamated into 1 Lot (Lot 174 on RP884826) in 1995. A one and two storey house stands cross the amalgamated Lot; the house originally stood on Lot 174 and was extended across the amalgamated Lot in 1996. Water, sewerage electricity and telephone reticulation are located along the Key Court frontage. A stormwater pipe is located within the subject property adjacent to north-eastern boundary; which provides stormwater drainage from Key Court to the canal at the rear of the property. Key Court is a good quality bitumen road with kerb and channel in place. A concrete footpath traverses the frontage of the property. A vehicular access to the Lot is located centrally along the frontage. The adjoining properties are used for detached housing with the adjacent Lots generally containing between 608m? to 800m? each. A copy of the Smartmap of the local area is attached as Appendix A.

2. PROPOSAL It is intended to Reconfiguration the subject property to create 2 lots as shown on the Plan of Development (Ref: 20-5225AA); attached as Appendix B. The new boundary is the re-instatement of the original boundary created on N21858. The new south-western Lot (Lot 1) contains 643m? and the north-eastern Lot (Lot 2) contains 625m?. It is intended that a significant part of the dwelling be demolished to eliminate the encroachment of the house over the new boundary. The new Lots will create the opportunity for the construction of two dwellings. A new driveway crossover to proposed Lot 1 is proposed to be constructed with the completion of the dwelling on the Lot. Infrastructure Contributions It is deemed that the contributions for 2 lots were paid at the time that the original 2 Lots were created. Therefore, it is deemed that infrastructure charges will not be payable at this time. 3. STATE PLANNING INTERESTS 3.1 State Planning Regulatory Provisions The site is included within the SEQ Regional Plan State Planning Regulatory Provisions — Land Use Category of Urban Footprint; the proposal is consistent with the Regional Plan. 3.2 Referral and State Development Assessment Provisions It is considered that the application will require referral to SARA as a concurrence agency. 3.3 State Planning Policies The site is not mapped as being affected by any of the State Planning Policies that are not appropriately integrated into the Noosa Plan 2020.

4. NOOSA PLAN 2020 41 Low Density Residential Zone Code The proposal complies with the Purpose and Overall Outcomes of the Zone Code as: e The development is within the character of the local area. The proposal enhances the low-density residential neighbourhood. e The distinct look of the Key Court precinct is retained as the development creates Lots of a scale of other properties in the street. 4.2 Reconfiguring a Lot Code The proposal complies with the Purpose and Overall Outcomes of the Reconfiguring a Lot Code as: e The area and dimensions of the new Lots are appropriate for the intended use. e The Lots are a reflection of the local character and require no modification of the local landform. e The development avoids significant adverse effects upon the natural environment. e The development provides an additional Lot within a safe and healthy community. All proposed Lots contain an area and a frontage that comply with the prescribed minimums for Lots in the relevant zone. With respect to Performance Outcomes 7 and 8 the lot design is the reinstatement of the original boundaries of the initia! development of the site. The development is responsive to the existing site and does not require any modification of the site. The development is constrained by the orientation of the existing street and canal pattern; however; each Lot contains sufficient area for a rectangle of 15m x 10m with the long axis in a north-south direction. 43 Acid Sulfate Soils Overlay Code The proposal complies with Purpose and Overall Outcomes of the subject Overlay Code as there is no proposed filling or excavation. 4.4 — Flood Hazard Overlay Code The level of the subject site is generally 2.5m above the Australian Height Datum and is therefore 100% of the Lots are above the Defined Flood Event. The development creates Lots that can safely and adequately accommodate the residential use. | | | |

5. CONCLUSION The proposal complies with the Specific Outcomes of the Noosa Plan 2020 with respect to Reconfiguration of a Lot. Accordingly, it is requested that the application be approved subject to reasonable and relevant conditions. Milde Max Watterson
