GENERAL COMMITTEE MEETING AGENDA 12 OCTOBER 2020

               The proposed change to the development approval requested by the applicant is
               determined to constitute a minor change on the grounds that:
        the development would not result in substantially different development as the
               proposed changes do not alter what the uses allowed under the original approval,
               whilst the built form changes are minor in terms of the overall scale and bulk of the
               existing development subject to the roof terrace pergolas being modified;
              the change does not include prohibited development;
        the change would not require the application to be referred to an additional referral
               agency or cause a referral agency to have regard to new matters prescribed by
               regulation;
        where the original application was code assessable, the change would not cause the
               application to become impact assessable.
       3.2. Instruments for Statutory Assessment
       Under the Planning Act 2016 the application must be assessed against each of the following
       statutory planning instruments to the extent they are relevant to the development:
              State Planning Policy;
              South East Queensland Regional Plan;
              Planning Regulation 2017;
              The Noosa Plan 2006.
       The following codes from the Noosa Plan 2006 are applicable to this development:
              Noosa Heads Locality Code;
              Business Uses Code;
              Residential Uses Code;
              Landscaping Code; and
              Engineering Works Codes.
       3.3. Statutory Instruments – Planning Scheme
       The proposed changes to Netanya raise a number of issues for consideration against the
       planning scheme, including setbacks, site cover, gross floor area, building height and roof
       form, and car parking. Each of these issues are addressed separately below.
       SETBACKS
       Probable Solution S8.1 of the Noosa Heads Locality Code requires buildings and other
            structures to be setback1:
       a) 2m, average of 4m from the front boundary to Hastings Street for the ground floor and
               2nd storey;
       b) 7m from the front boundary to Hastings Street above the 2nd storey; and
       c) 10m from the front boundary to The Parade (beach).

1setback means the minimum distance from any lot boundary to a building or structure, excluding eaves, roof overhangs and awnings
provided they encroach no more than 600mm into the setback distance.

                                                                                                             Page 22 of 84
