PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 DECEMBER 2018
As a result of this process a mediation agreement was entered into with the applicant which sought
to address a range of matters including:
Minimising the increase of hardstand within the road reserve;
Enabling the parking of motorbikes on an extended deck area adjacent to the northern
boundary; and
Preserving a view line adjacent to the northern and southern boundaries.
The amended plan was therefore required to be submitted which incorporated modifications to:
Marginally increase the hardstand in the road reserve;
Increase the depth of the northern bin storage deck adjacent to the front boundary by 1.0
metre; and
Use part of the northern deck for the purpose of motorbike parking.
A copy of the revised plan is included as Attachment 2.
The mediation agreement states that the appellant agrees to the imposition of condition/s of
development that the car parking areas to the north and south of the subject land are to remain
open and no structures are to be constructed thereon higher than that currently approved to the
southern visitor car park in order to preserve views. The height of the structure currently approved
to the southern visitor car park is 1.30 metres in height. Accordingly, it is recommended that the
following additional condition be included in the Decision Notice.
Additional condition added 20 December 2018:
63. The parking areas adjacent to the northern and southern boundaries of the subject land are
to remain open and no structures are to be constructed thereon with a height greater than
1.30 metres above the level of the car parking deck.
The proposed changes are considered suitable and will not have a detrimental on the amenity of
the area as they:
Preserve the opportunity for landscaping within the front boundary;
Maintain views adjacent to the northern and southern elevation; and
The area for motorbike parking is generally limited to the existing approved deck area.
It is recommended Council accept the mediated outcome and the recommendation is worded
accordingly.

The application was previously decided by Council officers under delegation.
