PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 11 DECEMBER 2018
Given the extent of changes, the proposal/development is considered to be operating more akin to
an Entertainment and Dining Business Type 3 – Bar (brewpub, hotel, or tavern). It is therefore
considered the development does not constitute a minor change as it is a substantially different
development to that approved.
The proposed Entertainment and Dining Business Type 3 - Bar/current operation is an inconsistent
use in the industrial zone which is of a scale not subordinate to the industrial business. The
Planning Scheme allows some non-industrial businesses to operate only when subordinate to the
industrial business on site or where not suited to a commercial zone. It is considered the
Entertainment and Dining Business is the primary use on site which is generally more suited to a
commercial zone. Furthermore, an Entertainment and Dining Business Type 3 use does not protect
industrial land for industrial uses.
The proposal is considered not to be a minor change and raises significant planning concerns and
is recommended to be refused.
