                  Council acknowledges receipt of your request for written advice in relation to the above
                  properties, specifically number 101 and provides the following information:

                  An approval was issued in 1977 (TPC 658) for “Renovations to existing building to permit
                  hardware store/tyre & wheel alignment service, office, storage and cabinet maker”. From
                  limited information on the file it would appear the pool shop and an associated pool display
                  had been operating prior to 1993. The pool display business has not been in operation for
                  sometime but the pool shop has continued to operate.

                  There is no evidence of a change to the original approval or an application to seek another
                  use at any time and therefore the pool shop has been operating in breach of the approval
                  for many years. .

                  An application to seek approval for the existing business would be required if your client
                  intends to continue the current use.
