PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 SEPTEMBER 2017
3. STATUTORY PROCESS
The applicant has requested to make a change to a development approval under s.369 of the
Sustainable Planning Act 2009. A request to change a development approval under s.369 can
only be made in circumstances where that change would constitute a ‘permissible change’.
The proposed change to the development approval requested by the applicant is determined to
not be a permissible change on the grounds that the proposed changes would result in a
substantially different development due to the proposed increase in site cover and changes in
built form. The proposed changes would require an application for a Material Change of Use and
would be subject to Impact Assessment.
4. ASSESSMENT
The key issues in the assessment of the application relate to built form, site cover, setback and
car parking. These issues are addressed in detail below.
Built form
The prevailing aspect of the existing built form is the roof form associated with the original
building. Whilst a vinyl roof cover has been added to the southern side of the building this
structure is not the dominant built form as it sits substantially lower than the apex of the pitched
roof. This is demonstrated in the following image.
Figure 12: Existing roof forms
The proposed changes seek to introduce significant built form through the bulkhead to the
southern and western elevations, the large pillars to the frontage and the raised tensile shade
sails. These are considered to be substantial alterations to the streetscape such that the
development has the appearance of shop front built close to the front boundary.
