PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 SEPTEMBER 2017
Schedule 1 of the Noosa Plan details setback requirements, for the subject site. The applicable
requirements are:
2m, average 4m from the front boundary to Hastings Street and Noosa Drive for the ground floor
and 2nd storey
The proposal has a front setback which varies between approximately 0.95m at 1.5m. The
setback area is to be partially landscaped however a substantial part of the setback area will
consist of hard surfacing attributed to the access steps and bench seat.
The proposed development does not accord with the Noosa Heads Locality Code as the
proposed works will result in a building form being significantly more dominant on the street. This
is in part attributed to the reduced setback to the Noosa Parade frontage and the increased site
cover which results in an absence of outdoor areas at ground level.
When the outdoor dining area was originally approved the delegate report noted that
approximately 30 square metres of outdoor dining was being added. The approval required
payment in lieu of 2 off-street car parking spaces. The current proposal seeks to use
approximately 55 square metres external to the building, this is comprised of 43 square metres
under the tensile shade sails and 12 square metres of use area to the rear of the site. The
additional 25 square metres results in a requirement for an additional 3 car spaces. The
application seeks an additional 22 seats in the dining area external to the original building.
No additional car spaces are proposed and therefore the proposal does not accord with Probable
Solution S7.1 of the Driveways and Carparking Code.
Specific Outcome 7 of the Driveways and Carparking Code states:
Sufficient carparking is provided to accommodate the number and type of vehicles likely to be
generated by the development having regard to the specifics of the use including
a) the type and intensity of land use;
b) any existing parking available on the site;
c) hours of operation;
d) likely numbers of users;
e) the peak parking demand periods of uses on the site; and
f) the availability of alternative carparking.
Due to the substantial capacity of the restaurant it is anticipated that the restaurant would
experience significant patronage with the style of cuisine (burgers) enabling a regular turnover of
customers. The site currently provides no car parking, acknowledging that payment was
previously made in lieu of car parking, and it is noted that availability of car parking within the
vicinity of the site is an existing issue.
Due to the increase in proposed outdoor seating and the absence of additional car parking it is
considered that the proposal does not meet Specific Outcome 7 of the Driveways and Car
Parking Code.
Advertising Devices
It is noted that the proposed plans include a number of illuminated devices which do not comply
with the Advertising Devices Code. These devices have not been assessed as part of this
application as approval would be required under a separate Operational Works application.
