PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 SEPTEMBER 2017

3. STATUTORY PROCESS
The proposed change to the development approval requested by the applicant is determined to
constitute a permissible change in accordance with S367 of the Sustainable Planning Act 2009
on the grounds that:
 The change would not result in a substantially different development as the use remains
the same as that approved. The changes reduce the overall number of units on the site and
slightly increase gross floor area from 18,610m2 to 19531.5m2, though it is noted that the
original approval was approved with a floor area of 21,950m2.
 The changes do not create a new referral trigger to the State Assessment and Referral
      Agency.
 The original development application was impact assessable and did not attract any public
submissions. The changes do not introduce significant new aspects (such as increases to
scale, changes in development footprint or different uses – though some of the buildings
result in a minor change in height) likely to cause persons to make submissions on
      reasonable grounds; and
 The changes do not involve prohibited development.
The application was referred to the Department of Infrastructure, Local Government & Planning
to seek its views in relation to the State concurrence agency requirements applying to the
existing approval. The Department responded on 5 July 2017 advising it has no objection to the
changes.
A previous change application was referred to Unitywater because the approval included water
and sewer conditions. Unitywater advised on 20 January 2016 it had no objection to the
proposed changes and that the existing water and sewer conditions should be maintained.
4. ASSESSMENT
Plans
The applicant requests endorsement of 90 amended proposal plans for the development. Copies
of the current approved plans and new proposal plans are included as Attachments 1 & 2.
In support of the proposed changes the applicant submits the following:
……The overall development is retained as an integrated multiple dwelling development, now
comprising 145 dwelling units together with minor ancillary activities including a shop,
café/restaurant and communal recreation facilitates. There are no new uses proposed that would
create different or additional impacts…..
The total number of dwellings intended by the development has reduced from the current
approval of 151 units and the original approval of 155 units. It is acknowledged that the
population density is anticipated as increasing to 426.5 persons (up from 404 persons under the
existing approval), however, we note that this density is anticipated by current planning policy.
Specifically, the current Planning Scheme envisages that development of land included within the
Semi-Attached Zone (as is the subject land) is developed at a density in the order of 100 persons
per hectare. With a land area of 4.262 hectares, this equates to a population density equivalent
to that which is proposed……
The only potential impacts that may be generated in this respect relate to traffic and servicing.....
Assessment of traffic generation and distribution is typically undertaken on a per unit / dwelling
basis. With an overall reduction in the total number of dwellings it is reasonably assumed that the
surrounding network is able to adequately accommodate the proposed amended development. In
relation to essential urban infrastructure such as water and sewer, it is also understood that such
assessment is typically undertaken on a per unit / dwelling basis. Likewise, with an overall
reduction in the total number of dwellings it is reasonably assumed that there is sufficient
capacity in the network to accommodate the proposed amended development….
