PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 12 SEPTEMBER 2017
Outdoor dining area
Figure 6: Outdoor dining area
In 1997 an application was lodged for a vinyl roof over the existing outdoor dining area to be
placed in the outdoor dining area, the application was a retrospective application as the roof
cover was already in place. The application was refused in September 1998 for the following
reasons:
1. The design of the framework on which the covering is attached is inadequate for high wind
loads
2. The applicant has not satisfactorily demonstrated that the covering meets the required fire
separation and wind retardation.
3. The excessive seating numbers in breach of the current conditions for the site cause the
existing toilet facilities to be inadequate.
4. The excessive seating numbers and the covering of the outdoor dining area increase
carparking demands in the locality and there is no provision to meet those requirements
under this application.
Council records indicate that subsequent to the refusal of the application communication was
sent to the property owner and occupier seeking the removal of the vinyl roof. It is noted that
these requests have not been complied with and the vinyl roof cover still remains on the site.
Approximately 44 square metres of site cover is attributable to the vinyl roof cover.
Development of outdoor areas associated with lightweight structures such as umbrellas
historically occurred along Hastings Street and the adjacent commercial streets as no approval
was required under earlier versions of the planning scheme (1980’s) and were not considered to
necessarily contribute to site cover. Some of these lightweight structures have been enhanced
and incrementally upgraded over time without any appropriate building or planning approval. This
has resulted in the transformation of lightweight structures into more solid permanent like
structures.
