3 MAYORAL MINUTES

                                                    MAYORAL MINUTE

I hereby give notice of my intention to move the following motion at the Ordinary Meeting on
Thursday, 7 May, 2015:

1 PERFORMANCE REVIEW COMMITTEE
         That Council:
         1. Appoint the Mayor and Cr Wilkie as the two Councillor representatives on the
                  Performance Review Committee; and
         2. Amend the role of the Performance Review Committee to be the conduct of the
annual performance appraisal of the Chief Executive Officer.

BACKGROUND

At the Ordinary Meeting on 3 April 2014, Council established a Performance Review Committee
(PRC). The purpose of the PRC was to conduct the annual performance appraisals of the CEO
and Directors, with membership comprising the Mayor (Chair) and Cr Bolton, and the relevant
Committee Chairs for the performance appraisals of the Directors.

The membership of the PRC has been reviewed and it is now time for another Councillor be
given the opportunity to participate in the process (similar to the rotation of the Committee Chairs
which has recently taken place). Similarly, the role of the PRC has been reviewed and a change
is required to clarify that the PRC is to only undertake the annual performance appraisal of the
CEO. The CEO is responsible for undertaking the performance appraisals of the Directors.

                                                                                        05/05/2015

ORDINARY MEETING AGENDA 7 MAY 2015

3 DEVELOPMENT APPLICATION FOR MATERIAL CHANGE OF USE FOR A MIXED USE
DEVELOPMENT (SERVICE STATION, SHOP, FAST FOOD RESTAURANT, CAR
WASH, SELF STORAGE FACILITY AND TOURIST PARK) AT 125 MYALL STREET
    COOROY MCU14/0056
That Council note the report by the Coordinator Planning to the Planning & Organisation
Committee Meeting dated 28 April 2015 and defer consideration of Application No. MCU
14/0056 for a Mixed Use Development at 12 Myall Street, Cooroy to a future Council
Meeting to allow further discussion with the applicant.
refuse Application No. MCU14/0056 for a Development Permit for Material Change of
Premises for a Mixed Use Development comprising: Retail Business Type 5 - Vehicle Uses
(Service Station & Car Wash), Entertainment & Dining Business Type 1 - Food &
Beverages (Fast Food Restaurant), Retail Business Type 2 – Shop (Convenience Retail),
Industrial Business Type 1 – Warehouse (Self-Storage Facility), Visitor Accommodation
Type 2 - Caravan Park (Tourist Park), situated at 125 Myall St, Cooroy for the following
    reasons:
    1. The development raises significant conflicts with The Noosa Plan and its land use
intent for the rural zone and water supply catchment area.
    2. The development conflicts with the Southeast Queensland Regional Plan policy
for drinking water catchment protection because it proposes expanded urban development
with Noosa’s water supply catchment area.
    3. The development represents a substantial expansion of Cooroy’s commercial
precincts that will further disperse and fragment its business centre, which is undesirable.
    4. The development will compound existing traffic problems at the Myall Street & Elm
    Street intersection, which is undesirable.
    5. The development is partly proposed within a mapped riparian buffer area on the
site, with insufficient basis provided to justify a reduced buffer.
    6. The applicant has not demonstrated sufficient grounds exist to overcome the
development’s conflicts with The Noosa Plan, with only low to moderate overall need
    apparent for the development.

    Procedural Motion
    Moved: Cr Playford
    Seconded: Cr Jurisevic

That the motion lies on the table until the Ordinary Meeting on 7 May 2015.
                                                                                       Carried.

     NOOSA
Cr Pardon declared a perceived conflict of interest in this matter (as defined in section 173 of the Local

item impartially and in the public interest and therefore remained in the meeting room for the debate on this
     matter.

That Council note the report by the Chief Executive Officer to the General Committee
Meeting dated 4 May 2015 and authorise the Chief Executive Officer to enter into a 2 year
