29.    Liability and   YEF to indemnify Council against loss or damage Council incurs, with a carve out for loss or damage caused or contributed to
       indemnity       by Council

                       Each party’s liability will be limited to an agreed limit.

                       None of the Parties will be liable for specified consequential losses.

                       Limit of liability and exclusion of consequential loss will be subject to certain standard carve outs

30.    Insurances      During the Construction Period, [YEF] to effect and maintain the following insurances:

                       •   Insurance of the Works

                       •   Public liability

                       •   Professional indemnity

                       •   Workcover

                       •   (possibly) industrial special risks

                       During the O&M Period, [YEF] to effect and maintain the following insurances:

                       •   Public liability

                       •   Professional indemnity

                       •   Workcover

                       •   (possibly) industrial special risks

                       Evidence of insurance to be provided prior to accessing the site and otherwise as requested by Council.

                       Failure to insure will allow Council to effect insurances and deduct premiums from payments to Contractor
