PLANNING & ENVIRONMENT COMMITTEE MEETING AGENDA 7 JUNE 2022
State and Other Statutory Instruments
State Planning Policy
Noosa Plan 2020 is generally consistent with the State Planning Policy July 2017 (SPP) and the
SPP raises no further issues relevant to the proposed development.
South East Queensland (SEQ) Regional Plan
The site is located within the Urban Footprint of the SEQ Regional Plan. The proposal is consistent
with the regional policies of the SEQ Regional Plan.
Planning Regulation 2017
The proposal is for urban activity within the Urban Footprint and is consistent with the assessment
benchmarks contained in the Planning Regulation 2017 for the SEQ Region.
3.2. Statutory Instruments – Planning Scheme
The application must be assessed against the whole of Noosa Plan 2020 to the extent the
provisions are relevant to the development.
Locality Provisions
The subject site is located in the Noosaville Locality and is zoned Medium Impact Industry. The
proposed use for undefined use is identified an inconsistent use. The application is required to
follow an impact assessable application process.
The Motorcycle/Scooter Sales & Repair use operates within the existing building and outdoor areas
on site from 9.00am-4.30pm Monday to Friday. The site plan identifies 180m2 of gross floor area
(GFA) for the industrial component and 131m2 of use area for the scooter and accessory sales
component. The existing building complies with setback, site cover and height requirements in
Noosa Plan. The new building proposed at the rear of the premises complies with the setback and
building height requirements.
Car Parking
The development provides for 6 car parking spaces for the Motorcycle/Scooter Sales and Repair
and 2 motorcycle spaces. As the proposal is for an undefined use minimum parking requirements
are not stipulated in Table 9.4.1.4 of the Driveways and Parking Code. Therefore, a comparison
against a Showroom use with regard to the sales component is described in Table 1 below, to
determine if the proposal meets Performance outcome PO35 of the Medium impact industry code,
which states:
PO35
Sufficient car parking is available to accommodate the number and type of vehicles likely to
be generated by the use on site.
Proposed GFA Noosa Plan requirements
Low impact industry 180m 2 GFA 1 space per 50m2 – 3.6 spaces
Scooter/motorcycle and accessory sales ‘Showroom’ – 1 space per 50m2 - 2.62 spaces
131m2
Total car spaces required by Noosa Plan 6.22
Total car spaces provided 6.5 (6 car spaces and 2 motorcycle spaces)
Table 1
It is also noted that 4 on street parking for motorbikes/scooters spaces are located directly in front
of the premises. These spaces were included in Council’s works program in 2015 and provided
shortly after. The quantity of motorcycle spaces and car parking spaces is considered sufficient for
the use and as demonstrated above, the proposal complies with Performance outcome PO35 with
the Driveways and Parking Code.
