Our ref: 210705 Council Ref: MCU21/0183 & OPW21/0292 03 December 2021 The Chief Executive Officer Noosa Council PO Box 141 TEWANTIN QLD 4565 Attention: Development Assessment – Patrick Murphy Via Email: [email protected] Dear Patrick, Re: Response to Council’s Information Request Development Permit for Material Change to Dual Occupancy & Operational Works 9 Ruby Street, Cooroy Lot 615 on C56014 Council ref: MCU21/0183 & OPW21/0292 I refer to Council’s Information Request, dated 05 November 2021 in relation to the abovementioned development. On behalf of the applicant, Christopher Robinson, and in accordance with Part 3(13) of the DA Rules 2017, we provide a response to all the issues raised. A response to the items raised in Councils Information Request is outlined below: ITEM 1: Provide Unity Water’s certification/letter confirming that the applicant has demonstrated compliance with Unity Water’s requirements for building over Unity Water’s assets. Response: Ingeniir has provided a response to Information Request (Attachment 1), which addresses items 1 – 5 of Council’s Information Request. With respect to Information Request Item 1, reference is made to the Concurrence Agency Referral Response issued by Unitywater, which approves the proposed structure, subject to compliance with the conditions of approval (included within Attachment 1). Due to this approval, no further evidence is required to address Information Request Item 1. ITEM 2: Provide an assessment of the potential impacts on adjoining properties due to the changes in overland flowpaths created by the proposed works. The assessment must be prepared by a suitably qualified person (RPEQ - Registered Professional Engineer Queensland). Page 1 of 4 Our ref: 210705

With respect to Information Request Item 2, Ingeniir (Attachment 1) details that the lot is located on a slight
ridge between Opal Lane and Ruby Street, with the site discharging to both street frontages.
Ingeniir confirms that the proposed development provides a preferred drainage arrangement by providing direct
surface falls to Opal Lane, rather than the current arrangement of draining to Opal Lane through the
neighbouring property to the west.
ITEM 3:
Provide RPEQ written certification, certifying that the proposed Earthworks and Stormwater
Management Plan will not cause a worsening of stormwater conditions by adversely altering
stormwater drainage characteristics external to the site, including, but not limited to:
a) additional ponding on neighbouring properties or on road reserve;
b) increased runoff onto neighbouring properties or road reserve
c) redirect overland flows.
Response:
With respect to Information Request Item 3, the Information Request response prepared by Ingeniir
(Attachment 1) provides the following response to the following response:
a. The property does not currently receive runoff from the surrounding properties as the Eastern boundary
is fenced with a sleeper at the base, which limits stormwater from the upstream allotments. As such the
proposed retaining along the Eastern boundary will not impact the existing flow regimes on the site or
neighbouring properties.
By providing positive surface drainage in the rear of the lot to Opal Lane the development will have a
beneficial impact on the neighbouring properties to the West.
b. The existing impervious area in the rear portion of the allotment (fronting Opal Lane) is comprised of 2
sheds and paved landscaping around the pool area totaling 170m2. The proposed roof area of the new
building is 160m2 hence is less than the existing impervious area to be removed as part of the
development, as such will be non-worsening for stormwater runoff.
c. The development only proposes to redirect surface flows on the rear portion of the allotment to avoid
draining to Opal Lane through the neighbouring property to the West; and will drain to Opal Lane
directly as a result which is considered a beneficial outcome.
ITEM 4:
Alternatively, provide an updated Stormwater Management Plan for the site, including,
but not limited to:
4.1details of any required stormwater pipelines/flowpaths within the site to drain low
areas on all adjoining properties to prevent additional stormwater ponding;
4.2 details of any required structures to collect and convey existing overland flows that are
impacted on by the construction of the proposed retaining walls.

Response:
Please refer to the updated Stormwater Management Plan prepared by Ingeniir (Attachment 2), which
addresses Information Request Item 4.
ITEM 5:
Provide amended plans, prepared by a RPEQ, detailing the proposed roadworks,
including but not limited to :
a) Pavement design, including connection to existing concrete pavement, thickness,
reinforcement, concrete strength, etc.;
b) Stormwater discharge details, including scour protection, cross sections, etc.
Response:
With respect to Information Request Item 5, the Information Request response prepared by Ingeniir
(Attachment 1) provides the following response to the following response:
a. Refer accompanying engineering plans revised to include the proposed pavement details matching that
of the IPWEAQ standard RS-051 crossover. Details have been added for pavement connection to
existing.
b. The stormwater from the site is to discharge to a kerb adapter in accordance with IPWEAQ standards.
The scour protection is provided by the pavement widening added to opal lane. Cross sections can be
found on the standard drawings for the outlet.
ITEM 6:
An amended plan detailing a 2 metre wide resumption at the Opal Lane frontage. It is important to
note that the front setback will be measured from the existing title boundary as opposed to the
resumed title boundary.
ITEM 7:
The front fence re-located so that it is setback 2.0 metres from the existing title boundary (re-located
to new front boundary as a consequence of the resumption).
Response:
Refer to accompanying amended Proposal Plans prepared by Valentine Building Design (Attachment 3), which
demonstrates a 2 metre wide resumption along the Opal Lane frontage. As demonstrated on the amended plans,
the front boundary fence is positioned on the re-aligned property boundary.
ITEM 8:
An amended landscape plan consisting of native species in accordance with Planning
Scheme Policy 2 – Landscaping.
ITEM 9:
The provision of landscaping between the existing dwelling and the front boundary.

Response:
Refer to the accompanying amended Landscape Plans prepared by Bird Landscape Design (Attachment 4). The
amended Landscape Plans are compliant with Planning Scheme Policy 2 – Landscaping, with the amended plans
demonstrating the use of 152 plants of which zero (0) are non-native plants. In addition to this, the amended
landscaping plans demonstrating the addition of landscaping between the existing dwelling and the front
boundary of Ruby Street.
This response represents our complete response to the Information Request issued by Council, and we look
forward to the decision notice being issued by Council in accordance with the relevant provisions of the
