APPLICATION DETAILS
Application No.	EXE24/0018
Applicant	Alison & Jamie Nicol C/- Mewing Planning Consultants Pty Ltd
Proposal	Dwelling House in Flood Overlay
Memo Completed Date	17 July 2024
Memo Reviewed By	Tara Norley - 18 July 2024
PROPERTY DETAILS
Property Address	39 Wyuna Drive Noosaville
RP Description	Lot 19 N10576
details
The proposed development is for a Dwelling House use on land at 39 Wyuna Drive, Noosaville, described as Lot 19 N10575. The entirety of the lot is burdened by Flood Hazard Overlays regulated by the Noosa Plan 2020. The proposed habitable floor levels of the dwelling house are to be constructed at or above the minimum habitable floor level specified by the flood overlay.
The Planning Act 2016 allows exemption certificates to be issued where ‘the development was categorised as assessable development because of an error’.
The Tables of Assessment for the Flood Hazard Overlay includes an error in that the table states ‘Building work not associated with a material change of use, including…’ whereby it should read ‘Building work not associated with a material change of use, excluding…’.
The proposal does not introduce any other non-compliances with flood overlay related assessment but will require assessment for building works relating to the scheme. These other matters will be assessed under a separate request.
