1. SITE 1.1. PROPERTY DETAILS: - Description: Lots 1 & 2 and Common Property on GTP105806 — a copy of a Smartmap is attached as Appendix A showing the location of the properties. Noosa Plan Zone: Rural Noosa Plan Locality: Mary River Catchment Overlays: Biodiversity - Environment Protection Area Bushfire Hazard Area — High Potential Bushfire Intensity Medium Potential Bushfire Intensity Potential Impact Buffer Slide Hazard Area SE Queensland Regional Plan: Regional Landscape and Rural Production Area. 1.2 SITE DESCRIPTION The subject property is a Community Title Scheme comprising 2 Lots of 2.16ha each and Common Property located on the south-western side of Eastern Branch Road approximately 3.5 kilometres from Pomona Kin Kin Road. 1/352 Eastern Branch Road (Lot 1) is a regular shaped allotment located at the eastern corner of the property containing a house and outbuildings, with a driveway providing access to Eastern Branch Road. 2/103 William Road (Lot 2) is a rectangular shaped allotment located along a ridge centrally within the property containing a shed, with a driveway providing access to Williams Road. The properties have been used for cropping and grazing uses in the past; and more recently have been undergoing rehabilitation. The properties are generally undulating to steep and covered by treed vegetation. Power and telephone services are connected and available to the properties from the relevant road frontages. Both Eastern Creek Road and Williams Creek Road are good quality gravel roads. The adjacent properties to the property range between 3.7ha and 19.7ha. 1.3. CURRENT SITUATION Noosa Council issued a Town Planning Consent Permit in December 1993 approving the use of the subject property as a duplex dwelling. Consequently a Community Title Scheme was created in 1997 comprising 2 Lots and Common Property. j j 1
Page 3
The Community Title Scheme was created under the provisions of the Building Unit and Group Titles Act 1980 (BUGTA) by carrying out a Group Title subdivision of the parent Lot. The 2 Lots created by a Group Title Scheme are freehold Lots with Common Property. The Building Unit and Group Titles Act 1980 was repealed in 1997 and replaced by the Body Corporate and Community Management Act 1997. Similar Community Titles Schemes created under the provisions of the Body Corporate and Community Management Act 1997 create Standard Format Lots with Common Property. 2. PROPOSAL It is intended to realign the common boundaries of the Lots of the Community Title Scheme as shown on the Plan of Proposed Reconfiguration (Ref: 93-223AB contained in Appendix B). The proposed new common boundaries are located to reflect the terrain, significant vegetation, mapped koala habitat and utilizes the existing property boundaries. The new lot layout reflects the use of the property and will improve the management and rehabilitation of the land. The proposed new Lots contain 15.73ha each and the Common Property has been reduced to 1713m?. The Common Property contains stock yards that are utilized by the owners of both Lots. The proposed new Lots contain the relevant structures, driveways, services and effluent disposal areas of the Lots. The existing driveway access points onto Eastern Branch Road and Williams Road will continue to be utilised following the Reconfiguration; and the provision of power and telecommunication services will remain in their current configuration following the Reconfiguration; as they are available to both proposed Lots. The existing Lots contain boundaries within the external boundaries totalling 899.97 metres. The proposed Lots will contain boundaries within the external boundaries totalling 884.97 metres. Therefore there is a minor reduction in the length boundaries of the development. The realignment has no impact upon the adjoining properties or upon the existing services. The new Lot areas will be within the range of the areas of adjacent properties.

3. STATUTORY ASSESSMENT — STATE GOVERNMENT 3.1 State Planning Regulatory Provisions The site is included within the SEQ Regional Plan State Planning Regulatory Provisions — Land Use Category of Regional Landscape and Rural Production; no additional Lots are created therefore no further assessment is required. 3.2 Referral and State Development Assessment Provisions A portion of the subject land is mapped as being affected by Category A or B vegetation; therefore it is considered that the application will require referral to SARA as a concurrence agency. There is generally a reduction of boundaries located within the area mapped Category A or B vegetation. A portion of the subject land is mapped as having Core Koala Habitat Area; therefore it is considered that the application will require referral to SARA as a concurrence agency. The new boundaries are generally located outside of the Core Koala Habitat Areas or where the linkages are of a minimal width. A plan showing the location of the new boundaries with respect to the Core Koala Habitat Area is attached as Appendix C. 3.3 State Planning Policies The site is not mapped as being affected by any of the State Planning Policy's State interest
